WIRELESS TELEGRAPHY ACT, 1926 (SECTION 3) (EXEMPTION OF SHORT RANGE BUSINESS RADIOS) ORDER, 1998 I, Etain Doyle, Director of Telecommunications Regulation, in exercise of the powers conferred on me by subsection
(6)(inserted by section 11 of the Wireless Telegraphy Act, 1972 (No. 5 of 1972)) of section 3 of the Wireless Telegraphy Act, 1926 (No. 45 of 1926), and section 4 of the Telecommunications (Miscellaneous Provisions) Act, 1996 (No. 34 of 1996), hereby order as follows: 1 Citation. 1. This Order may be cited as the Wireless Telegraphy Act, 1926 (Section 3) (Exemption of Short Range Business Radios) Order, 1998. 2 Interpretation Act. 2. The Interpretation Act, 1937 (No. 38 of 1937), applies to this Order. 3 Definitions. 3. In this Order— "CTCSS" means a continuous tone controlled signalling system; "DCS" means a digital coded squelch system. "e.r.p." means effective radiated power as defined in the Radio Regulations annexed to the Constitution of the International Telecommunications Union signed at Geneva on 6 November 1992; "hand-portable station" means apparatus for wireless telegraphy which is— (
- a)capable of being used for transmitting and receiving messages by means of radiated electro-magnetic waves, and (
- b)intended to be transported by hand and to be used while being moved or during halts at unspecified points; "integral antenna" means an antenna which is— (
- a)designed to be connected to the hand-portable station without the use of a 50 ohm external connector, (
- b)considered to be part of that station, and (
- c)capable of being fitted internally or externally to that station; "short range business radio" means apparatus for wireless telegraphy which— (
- a)consists of hand-portable stations with integral antennas used for speech communications, (
- b)conforms to the European Telecommunications Standard known as ETS 300-296, (
- c)uses channel spacing of 12.5 kHz, (
- d)has a maximum e.r.p. of 500 mW, (
- e)uses either CTCSS or DCS tone control, and (
- f)operates only on the following frequency channels: 446.00625 MHz 446.01875 MHz 446.03125 MHz 446.04375 MHz 446.05625 MHz 446.06875 MHz 446.08125 MHz 446.09375 MHz; "tone control" means a mechanism by which apparatus for wireless telegraphy transmits a specific signal for control purposes in addition to the speech signal. 4 Exemption. 4. Short range business radios are hereby declared to be a class of apparatus for wireless telegraphy to which section 3 of the Wireless Telegraphy Act, 1926 , does not apply. GIVEN under my hand, this 1st day of April, 1998 Etain Doyle Director of Telecommunications Regulation EXPLANATORY NOTE This Order provides for the exemption of short range business radio systems from the requirement to be licensed under the Wireless Telegraphy Act, 1926 . In order to qualify for this exemption a short range business radio system must be type approved and must conform with all other technical specifications laid down in this Order.
