AmendmentsLeasuithe The Minister for Health and Children in exercise of the powers conferred on him by Section 7 of the Health (Corporate) Bodies Act, 1961 (No. 27 of 1961), (as adapted by the Health (Alteration of Name of Department and Title of Minister) Order ( S.I. No. 308 of 1997 )), hereby orders as follows:— 1. This Order may be cited as the Saint Luke's and Saint Anne's Hospital Board (Revocation) Order, 1999. 2. In this Order— “Saint Luke's and Saint Anne's Hospital Board” means the Board established by the Saint Luke's and Saint Anne's Hospital Board (Establishment) Order, 1988 ( S.I. No. 322 of 1988 ); “Saint Luke's Hospital Board” means the Board established by the Saint Luke's Hospital Board (Establishment) Order, 1999; “member of the staff” includes an officer and a servant. 3. The following shall be and hereby are transferred to the Saint Luke's Hospital Board on the commencement of this Order:— (
4. a)All property (including choses-in-action), assets, rights, contracts of employment held or enjoyed immediately before that date by Saint Luke's and Saint Anne's Hospital Board. (
5. b)All liabilities incurred before that date by Saint Luke's and Saint Anne's Hospital Board that had not been discharged before that date. 4. Every person who immediately before the commencement of this Order is a member of the staff of the Saint Luke's and Saint Anne's Hospital Board, shall on the commencement of this Order be transferred to and become a member of the staff of the Saint Luke's Hospital Board. 5. Any act that was done by or on behalf of the Saint Luke's and Saint Anne's Hospital Board shall, if and in so far as it was operative immediately before the commencement of this Order, have effect on and after that commencement as if it had been done by or on behalf of the Saint Luke's Hospital Board. 6. Where, immediately before the commencement of this Order, any legal proceedings are pending in any court or tribunal and Saint Luke's and Saint Anne's Hospital Board, or any trustee or agent thereof acting on its behalf, is a party to the proceedings, Saint Luke's Hospital Board shall be substituted for the Saint Luke's and Saint Anne's Hospital Board or, as appropriate, the said trustee or agent thereof and the proceedings shall not abate by reason of such substitution. 7. The Saint Luke's and Saint Anne's Hospital Board (Establishment) Order, 1988, ( S.I. No. 322 of 1988 ) is hereby revoked. 8. This Order shall come into operation immediately after the commencement of the Saint Luke's Hospital Board (Establishment) Order, 1999.
