No. 346/1999 - Registry of Deeds (Fees) Order, 1999 AmendmentsLeasuithe I, JOHN O'DONOGHUE, Minister for Justice, Equality and Law Reform, in exercise of the powers conferred on me by section 35 of the Registry of Deeds (Ireland) Act, 1832 as adapted by the Registry of Deeds (Ireland) Act, 1832, (Adaptation) Order, 1956 ( S.I. No. 281 of 1956 ), and section 9 of the Land Transfer (Ireland) Act 1848 as adapted by the Land Transfer (Ireland) Act 1848 (Adaptation) Order, 1956 ( S.I. No. 180 of 1956 ), hereby order as follows: 1. This Order may be cited as the Registry of Deeds (Fees) Order, 1999. 2.
(1)The Interpretation Act, 1937 (No. 38 of 1937), applies to this Order.
(2)In this Order— “memorial”, other than in respect of item number 2 of the Schedule to this Order, includes an affidavit to register a judgement as a mortgage; “name” does not include any variation either of the forename or the surname. 3. This Order shall come into operation on the 1st day of February, 2000. 4. In lieu of the fees specified in the Schedule to the Registry of Deeds (Fees) Order, 1991 ( S.I. No. 360 of 1991 ), the fees specified in column number 2 of the Schedule to this Order shall be charged in the Office of the Registrar of Deeds in respect of the items specified in column number 1 of the Schedule to this Order. Common Search In respect of a common search upon names made by office under a requisition in respect of each name, for each county, for each period of ten years or part thereof 5.00 5. Continuation of a Common Search Continuation of a common search, in respect of each name, for each county, for each period of ten years or part thereof 5.00 6. Negative Search Negative search upon names made by office under a requisition in respect of each name, for each county, in respect of each period of ten years or part thereof 10.00 7. Continuation or Closing of Negative Search In respect of the continuation or closing of a negative search for each name, for each county, for each period of ten years or part thereof 10.00 8. Search by Members of Public Search by members of the public in respect of each name, for each county, for each period of ten years or part thereof 1.00 9. Copies For every certified copy of a memorial 10.00 Plain copy of microfilm of a memorial .50 per page 10. Entry of Satisfaction of Mortgage (
- a)In respect of entry of certificate of satisfaction of a judgement mortgage 10.00 (
- b)In respect of entering satisfaction of mortgage on record and granting certificate to like effect pursuant to section 84 of the Building Societies Act, 1976 (No. 38 of 1976), or section 18 of the Housing Act, 1998 (No. 28 of 1988). 10.00 11. Inspection of Original Memorial or Affidavit For every original memorial or affidavit produced for inspection in the Office 10.00 12. For Attendance of Officer to Produce Memorial or Other Document in Court For attendance of officer to produce memorial or other document in Court 50.00 in respect of each day of officer's attendance together with travel and subsistence expenses as actually incurred 13. General Search General search, without limitation, each day, by each member of the Public against all indexes prior to 1950 5.00 14. Other Services Providing any service for which no other fee is prescribed 5.00 GIVEN under my Official Seal, this 10th day of September, 1999. This Order, which comes into operation on the 1st day of February, 2000, provides for a revised scale of fees to be charged in the Registry of Deeds. This Order replaces the Registry of Deeds (Fees) Order, 1991.
