AmendmentsLeasuithe I, MARY HARNEY, Minister for Enterprise, Trade and Employment, in the exercise of the powers conferred on me by section 1

(4)of the Companies (Amendment) (No. 2) Act, 1999 (No. 30 of 1999), hereby order as follows:
  1. This Order may be cited as the Companies (Amendment) (No. 2) Act, 1999 (Commencement) Order,
  3. In this Order, the “Act” means the Companies (Amendment) (No. 2) Act, 1999 .
  4. The 21st day of December, 1999, is hereby appointed as the day on which the following provisions of the Act shall come into operation, namely— (a) Part I, (b) subsections
(2),
(3)and
(7)of section 33, (
  1. c)sections 40, 41, 52 and 53, (
  2. d)section 54 (other than subsection
(1)(a) of that section in so far as it relates to a company the memorandum of which was delivered to the registrar of companies for registration under section 17 of the Principal Act before the 24th day of December, 1999).
  1. The 1st day of February, 2000, is hereby appointed as the day on which the following provisions of the Act shall come into operation, namely Part II and the Second Schedule in so far as it relates to Part II.
  2. The 21st day of February, 2000, is hereby appointed as the day on which the following provisions of the Act shall come into operation, namely, Part III (other than subsections
(2),
(3)and
(7)of section 33), the First Schedule and the Second Schedule in so far as it relates to Part III. 6. The 24th day of February, 2000, is hereby appointed as the day on which section 54
(1)(a) of the Act, in so far as it is not already in operation on that day, shall come into operation. GIVEN under my Official Seal, this 20th day of December, 1999. MARY HARNEY, Minister for Enterprise, Trade and Employment. EXPLANATORY NOTE. (This note is not part of the Instrument and does not purport to be a legal interpretation.) This Order fixes the 21st day of December, 1999 as the day on which the provisions of Part I (Preliminary and General) and certain provisions of both Part III (request not to avail of exemption from statutory audit requirement being provided in this Part), and Part IV (various miscellaneous provisions) of the Companies (Amendment) (No. 2) Act, 1999 shall come into operation. This Order fixes the 1st day of February, 2000 as the day on which the provisions of Part II (amending the law in relation to Examinerships) shall come into operation. This Order fixes the 21st day of February, 2000 as the day on which certain provisions of Part III (containing the main provisions for the removal of statutory audit requirement from certain private limited companies and certain partnerships) shall come into operation. Finally, this Order fixes the 24th day of December, 2000 as the day on which certain provisions of Part IV (which apply to Investment Companies authorised under Part XIII of the Companies Act, 1990 ) shall come into operation.
