No. 242/2001 - Social Welfare (Consolidated Payments Provisions) (Amendment) (No. 3) (Sharing of Information) Regulations, 2001 AmendmentsLeasuithe The Minister for Social, Community and Family Affairs, in exercise of the powers conferred on him by sections 4 (as amended by section 9 of the Social Welfare Act, 2001 (No. 5 of 2001)), 223D, 223E and 223G (all inserted by section 32 of the Social Welfare Act, 2000 (No. 4 of 2000)) of the Social Welfare (Consolidation) Act, 1993 (No. 27 of 1993) hereby makes the following Regulations: Citation and construction. 1.

(1)These Regulations may be cited as the Social Welfare (Consolidated Payments Provisions) (Amendment) (No. 3) (Sharing of Information) Regulations, 2001.
(2)These Regulations and the Social Welfare (Consolidated Payments Provisions) Regulations, 1994 to 2001 shall be construed together as one and may be cited as the Social Welfare (Consolidated Payments Provisions) Regulations, 1994 to
  1. Amendment of regulations.
  2. The Social Welfare (Consolidated Payments Provisions) Regulations, 1994 ( S.I. No. 417 of 1994 ) are hereby amended by the insertion after article 106 of the following article: “Sharing of information. 106A.
(1)The information prescribed for the purposes of section 223D in relation to a pupil shall be - (
  1. a)his or her - (
  2. i)forename, (
  3. ii)surname, (iii) date of birth, (
  4. iv)address, (
  5. v)sex, (
  6. vi)nationality, and (vii) personal public service number, (
  7. b)whether he or she - (
  8. i)boards at his or her school, (
  9. ii)is participating in a scheme administered by the Minister for Education and Science and known as the Vocational Training Opportunities Scheme, (iii) is exempt from studying the Irish language and if so the date of exemption, and (
  10. iv)has special needs and if so the type of special needs, and (
  11. c)(
  12. i)the name and examination level of subjects which he or she is studying, (
  13. ii)the language through which he or she is studying, (iii) the examination for which he or she is studying and his or her candidate number, (
  14. iv)his or her class group and year, (
  15. v)his or her official school number, and (
  16. vi)his or her former school roll number.
(2)The information prescribed for the purposes of section 223E shall be a person's - (
  1. a)forename, (
  2. b)surname, (
  3. c)date of birth, (
  4. d)birth surname, (
  5. e)mother's birth surname, (
  6. f)address, (
  7. g)sex, (
  8. h)marital status, (
  9. i)date of marriage, (
  10. j)nationality, (
  11. k)insurance number, and (
  12. l)personal public service number.”.
(3)The information prescribed for the purposes of section 223G shall be - (
  1. a)in respect of a tenant, his or her - (
  2. i)forename, (
  3. ii)surname, (iii) (I) address, (II) date of commencement of rent supplement in respect of that address, and (III) date of cessation of rent supplement in respect of that address, and (
  4. iv)personal public service number, and (
  5. b)in respect of a landlord or his or her agent, his or her - (
  6. i)forename, (
  7. ii)surname, (iii) personal public service number, (
  8. iv)registration number assigned in accordance with section 9 (1A) of the Value Added Tax Act, 1972 (No. 22 of 1972), and (

These Regulations prescribe the information which a specified body may be required to share with the Department of Education and Science in relation to the use of the Personal Public Service Number as a unique student identifier at all levels of the education system. In addition, information which may be shared in relation to a person between the Department of Social, Community and Family Affairs and any other specified body for the purposes of seeking or giving that person's Personal Public Service Number, is specified. The Regulations also specify the information which may be shared between the Department of Social, Community and Family Affairs and Local Authorities in relation to tenancies supported through the Supplementary Welfare Allowance system in order to assist those authorities in carrying out their statutory responsibilities in relation to private rented accommodation.
