(2)of the Health (Nursing Homes) Act, 1990 (No. 23 of 1990) (as adapted by the Health (Alteration of Name of Department and Title of Minister) Order, 1997 ( S.I. No. 308 of 1997 )), which said powers are delegated to me by the Health and Children (Delegation of Ministerial Functions) Order, 2000 ( S.I. No. 32 of 2000 ) I, Dr. Tom Moffatt T.D., Minister of State at the Department of Health and Children hereby make the following Regulations:-
  1. These Regulations may be cited as the Nursing Homes (Subvention) (Amendment) Regulations,
  2. These Regulations shall come into operation on the 1st day of April,
  3. The Nursing Homes (Subvention) Regulations, 1993 ( S.I. No. 227 of 1993 ) are hereby amended by the substitution for the Fourth Schedule of the following:- FOURTH SCHEDULE MAXIMUM RATES OF SUBVENTION (PER WEEK) Level of Dependency (of the person seeking a subvention) Maximum Rates of Subvention (Per Week) €Euro As assessed under the First Schedule Dependency Assessment Procedure As per level of dependency Medium Dependency £90 €114.30 High Dependency £120 €152.40 Maximum Dependency £150 €190.50 Given under the Official Seal of the Minister for Health and Children this 20th day of March,

Tom Moffatt Minister of State at the Department of Health and Children EXPLANATORY NOTE (This note is not part of the Instrument and does not purport to be a legal interpretation) These Regulations amend the Nursing Homes (Subvention) Regulations, 1993, ( S.I. No. 227 of 1993 ) by increasing the rates of subvention payable from £70 to £90 in respect of medium dependency, from £95 to £120 in respect of high dependency and from £120 to £150 in respect of maximum dependency.
