No. 251/2002 - Public Health (Tobacco) Act, 2002, (Commencement) Order, 2002 AmendmentsLeasuithe I, Micheál Martin, Minister for Health and Children, in exercise of the powers conferred on me by section 1 of the Public Health (Tobacco) Act, 2002 , (No. 6 of 2002) hereby order as follows: 1. This Order may be cited as the Public Health (Tobacco) Act, 2002, (Commencement Order, 2002. 2. The 31st day of May, 2002 is hereby appointed as the day on which Part 2 of the Public Health (Tobacco) Act, 2002 shall come into operation. Given under my Official Seal this 28th day of May, 2002 Micheál Martin ________________________ Minister for Health and Children EXPLANATORY NOTE (This note is not part of the Instrument and does not purport to be a legal interpretation) This Order appoints the 31st day of May, 2002 as the date for the coming into operation of part 2 of the Public Health (Tobacco) Act, 2002 . Part 2 of the Act provides for the establishment of the Office of Tobacco Control on a statutory basis. The Office of Tobacco Control was established on an administrative basis in 2000. The Office will consist of a chairperson and 11 other members and will have a chief executive officer and staff. Other standard provisions for a statutory body are provided for in Part 2, e.g. functions, meetings, committees, remuneration, superannuation, etc. Part 2 of the Act also provides for the establishment of the Tobacco Free Council which will be established by the Office.
