No. 329/2002 - Housing (Miscellaneous Provisions) Act, 2002 Commencement (No. 2) Order, 2002 AmendmentsLeasuithe The Minister for the Environment and Local Government in exercise of the powers conferred on him by section 1
(3)of the Housing (Miscellaneous Provisions) Act, 2002 (No. 9 of 2002), hereby orders as follows:—
- This Order may be cited as the Housing (Miscellaneous Provisions) Act 2002 (Commencement) (No. 2) Order,
- The Housing (Miscellaneous Provisions) Act, 2002 except insofar as it has already been commenced and other than sections 4, 11, 17(a) 17(b), 17(e), schedule 1 and schedule 2 shall come into operation on the date of the making of this Order.
- Section 4 of and the First Schedule to the Housing (Miscellaneous Provisions) Act, 2002 shall come into operation on the date of the making of this Order to the extent specified in the Schedule to this Order. EXPLANATORY NOTE (This note is not part of the Instrument and does not purport to be a legal interpretation). This order commences sections 1 to 10, 13 to 16, 17(d), 18 to 24, Schedule 1 to the extent set out in the Order, and Schedule 3. Those sections not being commenced are Section 11 which relates to new house grants (and related portions of Schedule 1); Section 12 which took effect from the date of enactment of the Act; Sections 17(
- a)and 17(
- b)which extend the powers of the Housing Finance Agency (HFA) to lend for non housing related capital purposes and to lend to approved bodies (and Schedule 2); Section 17(
- c)which increases the borrowing limit of the HFA and which has previously been commenced by the Housing Miscellaneous Provisions (Commencement) Order, 2002, S.I. 163 of 2002.
