No. 472/2002 - Fishing Vessel (Radio Installations) (Amendment) Regulations 2002 AmendmentsLeasuithe I, Dermot Ahern, Minister for Communications, Marine and Natural Resources, in exercise of the powers conferred on me by section 19 of the Merchant Shipping Act 1992 (No. 2 of 1992), and the Marine and Natural Resources (Alteration of Name of Department and Title of Minister) Order 2002 ( S.I. No. 307 of 2002 ) hereby make the following Regulations: 1. These Regulations may be cited as the Fishing Vessel (Radio Installations (Amendment) Regulations 2002. 2. The Fishing Vessel (Radio Installations) Regulations 1998 are hereby amended by the substitution of the following for the definition of “new fishing vessel” in Regulation 2.
(1):- ‘ “new fishing vessel” means a fishing vessel for which: (
- a)on or after 1 January 1999 the building or major conversion contract is placed; or (
- b)the building or major conversion contract has been placed before 1 January 1999, and which is delivered three years or more after that date; or (
- c)in the absence of a building contract, on or after 1 January 1999: - the keel is laid, or - construction identifiable with a specific ship begins, or - assembly has commenced comprising at least 50 tonnes of 1% of the estimated mass of all structural material, whichever is less;’ GIVEN under my Official Seal, this 8th day of October 2002 Dermot Ahern _______________________________________________ Minister for Communications, Marine and Natural Resources. EXPLANATORY NOTE (THIS NOTE IS NOT PART OF THE INSTRUMENT AND DOES NOT PURPORT TO BE A LEGAL INTERPRETATION) These regulations amend the Fishing Vessel (Radio Installations) Regulations 1998 ( S.I. No. 544 of 1998 ). The purpose of this amendment is to revise the definition of a new fishing vessel to reflect the definition given in EU Directive 97/70.
