No. 505/2002 - Local Authorities (Declaration of Offices) Order, 2002 AmendmentsLeasuithe The Minister for the Environment and Local Government in exercise of the powers conferred on him by subsection
(1)of section 2 of the Local Authorities (Officers and Employees) Act, 1926 as amended by section 11 of the Local Government Act, 1998 , with the concurrence of the Local Appointments Commissioners, hereby orders as follows: -
- This order may be cited as the Local Authorities (Declaration of Offices) Order,
- This order shall come into effect on the 4th day of November,
- In this order, the “Act” means the Local Authorities (Officers and Employees) Act, 1926 .
- Each and every declaration made under section 2 of the Act applying the said Act to any office or employment under a local authority in relation to which the Minister for the Environment and Local Government is the appropriate Minister, for the purpose of section 156 of the Local Government Act, 2001 , is hereby revoked.
- Where, on or before the date of the coming into force of this order, the Local Appointments Commissioners have received a request made under Section 6 of the Act in respect of an office or employment which but for the making of this order, would be an office or employment to which the Act applied, that office or-employment shall continue to be an office or employment to which the Act applies for the purposes of that request. - EXPLANATORY NOTE (This note is not part of the instrument and does not purport to be a legal interpretation). This order revokes all previous declarations of offices made under section 2 of the Local Authorities (Officers and Employees) Act, 1926 applying that Act to any employment under a local authority in relation to which the Minister for the Environment and Local Government is the appropriate Minister.
