No. 529/2002 - Local Authorities (Declaration of Offices) (No. 2) Order, 2002 AmendmentsLeasuithe The Minister for the Environment and Local Government in exercise of the powers conferred on him by subsection
(1)of section 2 of the Local Authorities (Officers and Employees) Act, 1926 as amended by section 11 of the Local Government Act, 1998 , with the concurrence of the Local Appointments Commissioners, hereby orders as follows:-
- This Order may be cited as the Local Authorities (Declaration of Offices) (No. 2) Order, 2002
- This Order shall come into effect on the 18th day of November
- In this Order, the “Act” means the Local Authorities (Officers and Employees) Act, 1926 . 4.
(1)Subject to paragraph
(2), every permanent office and employment under a local authority in respect of which the Minister for the Environment and Local Government is the appropriate Minister for the purpose of Section 156 of the Local Government Act, 2001 , the maximum salary for which is not less than the maximum salary for the time being for the office or employment of Senior Executive Engineer is hereby declared to be an office to which the Act applies.
(2)The provisions of paragraph
(1)shall not apply to the offices or employments described in the Schedule to this order.
- Where, before the date of the coming into force of the Local Authorities (Declaration of Offices) Order, 2002, a local authority has advertised a competition for an office or employment which on the making of this Order will be an office to which the Act applies, that office or employment shall not be an office to which the Act applies for the purposes of that competition.
