No. 215/2003 - Harbour Rates (Tralee and Fenit Pier and Harbour) Order 2003 AmendmentsLeasuithe I, Dermot Ahern, Minister for Communications, Marine and Natural Resources, in exercise of the powers conferred on me by section 104 of the Harbours Act 1946 (No. 9 of 1946) and the Communications (Transfer of Departmental Administration and Ministerial Functions) Order 1987 ( S.I. No. 91 of 1987 ) (as adapted by the Marine and Natural Resources (Alteration of Name of Department and Title of Minister) Order 2002 ( S.I. No. 307 of 2002 )), hereby order as follows: 1.

(1)This Order may be cited as the Harbour Rates (Tralee and Fenit Pier and Harbour) Order 2003.
(2)This Order comes into operation on 1 June, 2003. 2.
(1)The rates set out in - (
  1. a)Schedule 1 to this Order are fixed as the maximum rates to be charged for goods, and (
  2. b)Schedule 2 to this Order are fixed as the maximum rates to be charged for tonnage on vessels, by Tralee and Fenit Pier and Harbour Commissioners in respect of Tralee and Fenit Pier and Harbour.
(2)Where the rates fixed under this Order are payable per tonne or per ton, lesser weights shall be chargeable at a weight calculated to nearest first decimal place.
(3)A vessel sailing from Tralee and Fenit Pier and Harbour which puts back to the harbour due to stress of weather, without having accomplished its voyage, shall not on its return to the be, charged a rate fixed under this Order, where it has paid the appropriate rate before sailing. 3. The following are revoked - (
  1. a)the Harbour Rates (Tralee and Fenit Pier and Harbour) Order 1954 ( S.I. No. 266 of 1954 ), and (
  2. b)the Harbour Rates (Tralee and Fenit Pier and Harbour Order 1997 ( S.I. No. 528 of 1997 ). SCHEDULE 1 Regulation 2

  1. b)Maximum Tonnage Rates Reference Number Description of tonnage of vessel Rate 1. Tonnage rate on every vessel not referred to in Reference No. 2 or 3 below, on every ton of the net register tonnage or of half the gross tonnage, whichever is the greater (
  2. a)entering or leaving the harbour for the purpose of loading or discharing cargo €1.12 (
  3. b)wind-bound or otherwise and not loading or discharging cargo €0.47 (
  4. c)remaining in the harbour longer than 7 days, for each further period of 14 days or part thereof €0.38 2. Tonnage rate on any vessel of 100 tons gross or over berthing at the quays within the harbour if it is - a fishing vessel - a pleasure craft, sailing boat, motor boat, or - a vessel plying for hire (
  5. a)on every such vessel not paying the composite rates set out at reference number (
  6. b)below, for each entry into the harbour if it is (
  7. i)under 3 tons gross €10.00 (
  8. ii)3 tons gross or over but under 6 tons gross €12.50 (iii) 6 tons gross or over but under 10 tons gross €15.00 (
  9. iv)10 tons gross or over but under 20 tons gross €22.50 (
  10. v)20 tons gross or over but under 40 tons gross €30.00 (
  11. vi)40 tons gross or over but under 60 tons gross €37.50 (vii) 60 tons gross or over but under 80 tons gross €45.00 (viii) 80 tons gross or over but under 100 tons gross €52.50 (
  12. b)on every such vessel using the harbour as a composite in full of tonnage rates payable annually in advance by 1 January in each year, or on entry into the harbour, if it is (
  13. i)under 1 ton gross €50.00 (
  14. ii)1 ton gross or over but under 3 tons gross €75.00 (iii) 3 tons gross or over but under 6 tons gross €110.00 (
  15. iv)6 tons gross or over but under 10 tons gross €145.00 (
  16. v)10 tons gross or over but under 20 tons gross €220.00 (
