No. 481/2003 - Tobacco Smoking (Prohibition) Regulations 2003 AmendmentsLeasuithe I, Micheál Martin, Minister for Health and Children, in exercise of the powers conferred on me by section 47 of the Public Health (Tobacco) Act 2002 (No. 6 of 2002), hereby make the following regulations: 1.
(1)These Regulations may be cited as the Tobacco Smoking (Prohibition Regulations 2003.
(2)These Regulations shall come into operation on 26 January
- The smoking of tobacco products in a place or premises (other than a dwelling specified in the Schedule to these Regulations is prohibited.
- The Tobacco (Health Promotion and Protection) Regulations 1995 ( S.I. No. 359 of 1995 ) are revoked. SCHEDULE
- A place of work.
- An aircraft, train, ship or other vessel, a public service vehicle or other vehicle used for the carriage of members of the public for reward, in so far as it is a place of work.
- A place or premises to which paragraph (b), (c), (d) or (e) of section 47
(1)of the Public Health (Tobacco) Act 2002 (No. 6 of 2002) applies, in so far as it is a place of work.
- A licensed premises, in so far as it is a place of work.

- With effect from 26 January 2004 the Regulations prohibit the smoking of tobacco products in a place or premises (other than a dwelling) as specified in the Schedule to the Regulations. The places or premises so specified are:-
- A place of work.
- An aircraft, train, ship or other vessel, a public service vehicle or other vehicle used for the carriage of members of the public for reward, in so far as it is a place of work.
- A place or premises to which paragraph (b), (c), (d) or (e) of section 47
(1)of the Public Health (Tobacco) Act 2002 (No. 6 of 2002) applies, in so far as it is a place of work.
- A licensed premises, in so far as it is a place of work.
- A registered club, in so far as it is a place of work. The Regulations also revoke the Tobacco (Health Promotion and Protection Regulations 1995 ( S.I. No. 359 of 1995 ).
