EUROPEAN COMMUNITIES (SEED OF FODDER PLANTS) (AMENDMENT) REGULATIONS 2004. I, JOE WALSH, Minister for Agriculture and Food, in exercise of the powers conferred on me by section 3 of the European Communities Act 1972 (No. 27 of 1972) and for the purpose of giving effect to Commission Directive 2004/55/EC of 20 April 20041 , hereby make the following regulations— 1. These Regulations may be cited as the European Communities (Seed of Fodder Plants) (Amendment) Regulations 2004 and comes into operation on 30 September 2004. 2. The European Communities (Seed of Fodder Plants) Regulations 2002 ( S.I. No. 198 of 2002 ) are amended— (
  4. a)in Regulation 2

(1)by substituting in the definition of fodder plants for— (
  1. i)“Festuca pratensis Huds. x Lolium multiflorm Lam.” The following: “Festuca ssp. x Lolium ssp.”, and (
  2. ii)“Hyprid resulting from the crossing of tall fescue with Italian ryegrass (including Wester-world ryegrass) (x festulolium)” the following: “Hybrids resulting from the crossing of a species of the genus Festuca with a species of the genus Lolium (x Festulolium)”, (
  3. b)in Regulation 2
(2)by substituting for “and Council Directive 2001/64/EC of 31 August 200134 .” the following: “, Council Directive 2001/64/EC of 31 August 200134 and Commission Directive 2004/55/EC of 20 April 200435 .”, (
  1. c)in Schedule 1, Annex II, column 2 of the table, for the entry relating to Vicia faba, by substituting “85” for “80”, (
  2. d)in Schedule 1, Annex IV, A I(a)4 by inserting after “in roman characters.” the following: “In the case of x Festulolium the names of the species within the genus Festuca and Lolium shall be indicated.”, (
  3. e)in Schedule 1, Annex IV, A I(b)4 by inserting after “and officially recorded.” the following: “In the case of x Festulolium the names of the species within the genus Festuca and Lolium shall be indicated.”, (
  4. f)in Schedule 1, Annex V, (A) 2 by inserting after “in roman characters,” the following: “in the case of x Festulolium the names of the species within the genus Festuca and Lolium shall be indicated,”, (
  5. g)in Schedule 1, Annex V, (C) 2 by inserting after “in roman characters,” the following: “in the case of x Festulolium the names of the species within the genus Festuca and Lolium shall be indicated,”.
