No. 913/2004 - European Communities (Avian Influenza) (Control on Imports of Avian Products and Live Birds from Certain Asian Countries) (Amendment) Regulations 2005 AmendmentsLeasuithe I, MARY COUGHLAN, Minister for Agriculture and Food, in exercise of the powers conferred on me by section 3 of the European Communities Act 1972 (No. 27 of 1972), and for the purpose of giving effect to Commission Decision 2004/851/EC1 of 14 December 2004, hereby make the following regulations— 1. These Regulations may be cited as the European Communities (Avian Influenza) (Control on Imports of Avian Products and Live Birds from certain Asian countries) (Amendment) Regulations 2005. 2. The European Communities (Avian Influenza) (Control on Imports of Avian Products and Live Birds from certain Asian countries) Regulations 2004 ( S.I. No. 432 of 2004 ) as amended by, The European Communities (Avian Influenza) (Control on Imports of Avian Products and Live Birds from certain Asian countries) (Amendment) Regulations 2004 ( S.I. No. 536 of 2004 ) are amended by: (
- a)The substitution for the definition of “Commission Decision” in regulation 2
(1)by: “Commission Decision” means Commission Decision 2004/122/EC2 as amended by Commission Decision 2004/606/EC3 and by Commission Decision 2004/851/EC. (b) The substitution of Regulation 6
(1)by: “Subject to paragraph
(2), a person, including the master or person in charge of a vehicle, shall not import certain avian product from South Korea and Malaysia”. GIVEN under my Official Seal, 22 December, 2004.
