No. 216 of 2005 IRISH AVIATION AUTHORITY (AERODROMES AND VISUAL GROUND AIDS) (AMENDMENT) ORDER, 2005 IRISH AVIATION AUTHORITY (AERODROMES AND VISUAL GROUND AIDS) (AMENDMENT) ORDER, 2005 S.I. No. 216 of 2005 The Irish Aviation Authority, in pursuance of Sections 5, 58, 59 and 60 of the Irish Aviation Authority Act, 1993 (No. 29 of 1993) as amended, hereby orders as follows: Short title and commencement 1.
(1)This Order may be cited as the Irish Aviation Authority (Aerodromes and Visual Ground Aids) (Amendment) Order, 2005.
(2)In this Order “the Principal Order” means the Irish Aviation Authority (Aerodromes and Visual Ground Aids) Order, 2000 ( S.I. No 334 of 2000 ).
(3)The Principal Order and this Order may be cited together as the Irish Aviation Authority (Aerodromes and Visual Ground Aids) Orders 2000 and 2005.
(4)This Order shall come into operation with immediate effect on the date of its publication in the Iris Oifigiúil. Amendment of the Principal Order 2. In paragraph
(1)of Article 5 of the Principal Order delete the text of subparagraphs
(1)(
- d)and (e and replace each subparagraph text with the following text respectively: “(
- d)in the case of a rotorcraft or balloon, not being used for public transport, any place where the aircraft may take-off or land without undue hazard to persons or property and in respect of which the owner or occupier of that place shall have given permission for such use, except that, in the case of a rotorcraft, where that place is of an elevated construction, located on the roof of a building or a structure, it shall also be licensed by the Authority under this Order for such use by that rotorcraft;” “(
- e)in the case of a rotorcraft or balloon used for public transport and so authorised by the Authority, any place where the aircraft may take-off or land without undue hazard to persons or property and in respect of which the owner or occupier of that place shall have given permission for such use, except that, in the case of a rotorcraft, where that place is of an elevated construction located on the roof of a building or a structure, it shall also be licensed by the Authority under this Order for such use by that rotorcraft.” Given under the common seal of the Irish Aviation Authority this 25th day of April, 2005.
