No. 379 of 2005 ORDER entitled Ministerial and Parliamentary Offices (Allowances and Salaries) Order 2005 Ministerial and Parliamentary Offices (Allowances and Salaries) Order 2005 The Government, in exercise of the powers conferred on them by - (
- a)section 8A of the Ministerial and Parliamentary Offices Act 1938 (No. 38 of 1938) (being that section as inserted by section 11 of the Oireachtas (Allowances to Members) and Ministerial and Parliamentary Offices (Amendment) Act 1973 (No. 22 of 1973), and amended by section 7 of the Oireachtas (Allowances to Members and Ministerial, Parliamentary and Judicial Offices (Amendment Act 1977 (No. 29 of 1977), sections 6, 8 and 9 of the Oireachtas (Allowances to Members) and Ministerial, Parliamentary and Judicial Offices (Amendment) Act 1983 (No. 32 of 1983) and section 8 of the Ministerial, Parliamentary and Judicial Offices and Oireachtas Members (Miscellaneous Provisions) Act 2001 (No. 33 of 2001)), and (
- b)section 10 of the Ministerial and Parliamentary Offices Act 1938 (being that section as inserted by section 10 of the Ministerial Parliamentary and Judicial Offices and Oireachtas Members (Miscellaneous Provisions) Act 2001 ), hereby order as follows: 1. This Order may be cited as the Ministerial and Parliamentary Offices (Allowances and Salaries) Order 2005. 2. In this Order - “Act of 2001” means the Ministerial, Parliamentary and Judicial Offices and Oireachtas Members (Miscellaneous Provisions) Act 2001 (No. 33 of 2001); “Principal Act” means the Ministerial and Parliamentary Offices Act 1938 (No. 38 of 1938). 3.
(1)The annual sum by way of salary payable under section 3
(1)(inserted by the Act of 2001) of the Principal Act shall be, with effect from 1 July 2005, a sum not exceeding - (
- a)in the case of the Taoiseach, €155,810, (
- b)in the case of the Tánaiste, €121,975, and (
- c)in the case of a member of the Government, other than the Taoiseach or the Tánaiste, €105,057.
(2)The annual sum by way of salary payable under section 3
(2)(inserted by the Act of 2001) of the Principal Act to Minister of State appointed under section 1 of the Ministers and Secretaries (Amendment) (No. 2) Act, 1977 (No. 28 of 1977) shall be, with effect from 1 July 2005, a sum not exceeding €45,845. 4. The annual sum by way of salary payable under section 4 (inserted by the Act of 2001) of the Principal Act to the Attorney General shall be, with effect from 1 July 2005, a sum not exceeding - (
- a)in case the person who holds the office is not a member of either House of the Oireachtas, €192,304, and (
- b)in case a member of either House of the Oireachtas holds the office €105,057. 5. The annual sum by way of salary payable under section 5 (inserted by the Act of 2001) of the Principal Act shall be, with effect from 1 July 2005, a sum not exceeding - (
- a)in the case of the Chairman of Dáil Éireann, €105,057, and (
- b)in the case of the Deputy Chairman of Dáil Éireann, €45,845. 6. The annual sum by way of salary payable under section 6 (inserted by the Act of 2001) of the Principal Act shall be, with effect from 1 July 2005, a sum not exceeding - (
- a)in the case of the Chairman of Seanad Éireann, €41,396, and (
- b)in the case of the Deputy Chairman of Seanad Éireann, €22,787. 7. The annual sum by way of salary payable under section 6A (inserted by the Act of 2001) of the Principal Act to the Leader of Seanad Éireann shall be, with effect from 1 July 2005, a sum not exceeding €18,090. 8. The annual sum by way of an allowance for expenses payable under section 10 (inserted by section 1 of the Oireachtas (Ministerial and Parliamentary Offices (Amendment) Act 2001 (No. 30 of 2001)) of the Principal Act, shall be, with effect from 1 July 2005, a sum not exceeding - (
- a)where payable under subsection
(1)(a)(
- i)of the said section 10 €60,109, (
- b)where payable under subsection
(1)(a)(
- ii)of the said section 10 €48,086, (
- c)where payable under subsection
(1)(a)(iii) of the said section 10 €24,049, (d) where payable under subsection
(1)(b)(
- i)of the said section 10 €39,304, (
- e)where payable under subsection
(1)(b)(
- ii)of the said section 10 €19,652, (
- f)where payable under subsection
(3)(
- a)of the said section 10 €34,586, and (
- g)where payable under subsection
(3)(b) of the said section 10 €19,

This Order applies increases with effect from 1 July 2005 to the salaries of Ministerial and Parliamentary office holders, arising from the recommendations in Report No. 40 of the Review Body on Higher Remuneration in the Public Sector together with an increase in the sums payable to leaders of qualified parties and Independents in Dáil and Seanad Éireann with effect from 1 July
