No. 468 of 2006 PRIVATE SECURITY (LICENSING AND QUALIFICATIONS) REGULATIONS 2006 The Private Security Authority, in exercise of the powers conferred on it by section 51 of the Private Security Services Act 2004 (No. 12 of 2004) and with the consent of the Minister for Justice, Equality and Law Reform, hereby makes the following regulations: 1. These Regulations may be cited as the Private Security (Licensing and Qualifications Regulations 2006. 2. These Regulations come into operation on the 1st day of September 2006. 3.

(1)In these Regulations - “Act” means the Private Security Services Act 2004 ; “door supervisor (licensed premises)” means an individual who provides security services as a door supervisor at or in the vicinity of licensed premises; “door supervisor (licensed premises) licence” means a licence issued under these Regulations and authorising an individual to perform the functions of a door supervisor (licensed premises); “individual” means an individual who is - (
  1. a)a private security employer or other independent contractor, or (
  2. b)an employee or agent of such an employer or of such a contractor, whether the employer or contractor is an individual, a body corporate or an unincorporated body of persons; “licensed premises” means: (
  3. a)premises licensed for the sale of intoxicating liquor under the Licensing Acts 1833 to 2004; (
  4. b)premises licensed under the Public Dance Halls Acts 1935 to 2003, (
  5. c)premises licensed under the Gaming and Lotteries Acts 1956 to 1986, (
  6. d)a club registered under the Registration of Clubs Acts 1904 to 2004; (
  7. e)food premises, or a food stall or food vehicle, within the meaning of the Food Hygiene Regulations 1950 to 1989; “security guard (static)” means an individual who as a security guard guards property for the purposes of preventing loss, damage or waste by crime, fire, carelessness or flood; “security guard (static) licence” means a licence issued under these Regulations and authorising an individual to perform the functions of a security guard (static). 4. The following categories of licence may be issued by the Authority to an individual: (
  8. a)door supervisor (licensed premises) licence, (
  9. b)security guard (static) licence. 5. (
  10. a)Following are the qualifications to be held by the following categories of licensee, in so far as those qualifications are applicable to the licensee concerned: Category of licensee Qualification door supervisor (licensed premises) FETAC Level 4 Minor Module in Door Security Procedures or equivalent security guard (static) FETAC Level 4 Minor Module in Basic Guarding Skills or equivalent (
  11. b)In subparagraph (
  12. a)“equivalent” means a qualification which in the opinion of the Authority is equivalent to the qualification mentioned in that subparagraph. The Minister for Justice, Equality and Law Reform consents to the making of the foregoing Regulations.
