I, MARY HARNEY, Minister for Health and Children, in exercise of the powers conferred on me by section 1

(2)of the Public Health (Tobacco) Act 2002 (No. 6 of 2002), hereby order as follows:
  1. This Order may be cited as the Public Health (Tobacco) Act 2002 (Commencement) Order
  3. In this Order “Act of 2002” means the Public Health (Tobacco) Act 2002 (No. 6 of 2002). 3.
(1)Section 45 of the Act of 2002 shall come into operation on the date of the making of this Order.
(2)The 31st day of May 2007 is appointed as the day on which subsections
(1)and
(3)of section 38 (inserted by section 9 of the Public Health (Tobacco) (Amendment) Act 2004 (No. 6 of 2004)) of the Act of 2002 shall come into operation. GIVEN under my Official Seal, 2 April 2007 MARY HARNEY Minister for Health and Children. EXPLANATORY NOTE (This note is not part of the Instrument and does not purport to be a legal interpretation). This Order may be cited as Public Health (Tobacco) Act 2002 (Commencement) Order 2007. The Order commences section 45 with effect from the date of making this order and subsections
(1)and
(3)of section 38 (inserted by Section 9 of the Public Health (Tobacco) (Amendment) Act 2004 ) of the Public Health (Tobacco) Act 2002 , from 31 May 2007.
