exercise of the powers conferred on me by section 39 of the Electricity Regulation Act 1999 (No. 23 of 1999) and the Communications, Energy and Geological Survey of Ireland (Transfer of Departmental and Ministerial Functions) Order 2002 ( S.I. No. 300 of 2002 ) (and as adapted by the Marine and Natural Resources (Alteration of Name of Department and Title of Minister Order 2002 ( S.I. No. 307 of 2002 )),

consideration of general social, economic and environmental factors and following consultation with the Minister for the Environment, Heritage and Local Government, and having,

accordance with section 39

(10)of the Electricity Regulation Act 1999 , given a draft of this Order to the Electricity Supply Board, being the person upon whom the obligations are to be imposed, hereby order as follows:
  1. This Order may be cited as the Electricity Regulation Act 1999 (Public Service Obligations) (Amendment) Order
  3. The Electricity Regulation Act 1999 (Public Service Obligations) Order 2002 ( S.I. No. 217 of 2002 ) is amended: (a)

Article 2

(1)by substituting the following for the definition of “levy period”: “ ‘levy period’ means such period as the Commission may from time to time designate following public consultation; ”, (b)

Article 9

(3)(a) by substituting “At least 5 months prior to the commencement of” for “No later than 30 April

the year immediately preceding”, (c)

Article 9

(3)(b) by substituting “At least 5 months prior to the commencement of” for “No later than 30 April

the year immediately preceding”, (d)

Article 9

(3)(c) by substituting “At least 3 months prior to the commencement of a levy period” for “No later than 1 July

the year immediately preceding the levy period concerned”, (e)

Article 9

(3)(e)(v) of the Principal Order is amended by substituting “at least 2 months before the commencement of a levy period” for “no later than 1 August

the year immediately preceding the levy period”, (f)

Article 9

(3)(f) by substituting “

accordance with paragraph

(3)(e),” for “

accordance with paragraph

(3)(e).”, (g)

Article 9

(3)by

serting the following subparagraph after subparagraph (f): “(g) The Commission shall notify all suppliers, the Board, the distribution system operator and the transmission system operator of any change to the commencement date of a levy period at least 6 months

advance of that date.”, (h)

Article 10

(1)by substituting “No later than 7 months after the end of each levy period-“ for “Within 120 days of the end of each levy period-”, and (i)

(2)by substituting “Within 60 days of receipt of all of the

formation’ for “Within 60 days of receipt of the
