The Minister for Social and Family Affairs, in exercise of the powers conferred on him by section 1

(4)of the Social Welfare and Pensions Act 2007 (No. 8 of 2007), hereby orders as follows:
  1. This Order may be cited as the Social Welfare and Pensions Act 2007 (Section 37) (Commencement) (No. 2) Order
  3. The 17th day of September 2007 is appointed as the day on which section 37 of, and Part 2 of Schedule 2 to, the Social Welfare and Pensions Act 2007 (No. 8 of 2007) come into operation in so far as section 3A of the Pensions Act 1990 (No. 25 of 1990) is amended pursuant to those provisions. GIVEN under the Official Seal of the Minister for Social and Family Affairs, 11 September 2007 MARTIN CULLEN Minister for Social and Family Affairs. EXPLANATORY NOTE (This note is not part of the Instrument and does not purport to be a legal interpretation.) This Order provides for the commencement of section 37 of the Social Welfare and Pensions Act 2007 , in so far as it relates to section 3A of the Pensions Act 1990 . Section 37 and Part 2 of Schedule 2 of the Social Welfare and Pensions Act 2007 , amend section 3A of the Pensions Act 1990 (as inserted by section 39 of the Social Welfare Law Reform and Pensions Act 2006 ) to specify the sections of the Pensions Act, a contravention of which will warrant the application of an on-the-spot fine. This amendment takes effect from 17 September 2007, the same date as the on-the-spot fines regime under section 3A of the Pensions Act comes into operation. Section 3A of the Pensions Act (inserted by section 39 of the Social Welfare Law Reform and Pensions Act 2006 ) comes into operation on 17 September 2007 via the Social Welfare Law Reform and Pensions Act 2006 (Section 39) (Commencement) Order
  4. All other amending provisions of Part 2 of Schedule 2 of the Social Welfare and Pensions Act 2007 were commenced with effect from the 27th April 2007 via the Social Welfare and Pensions Act 2007 (Section 37) (Commencement) Order 2007 (S.I. 181 of 2007).
