I, MARY HARNEY, Minister for Health and Children, in exercise of the powers conferred on me by section 20

(1)(d) of the Health (Repayment Scheme) Act 2006 (No. 17 of 2006), hereby make the following Regulations: Citation.
  1. These Regulations may be cited as the Health (Repayment Scheme) (Charge for Administering Patients’ Private Property Accounts) Regulations
  2. Executive may impose administrative charge in respect of certain patients’ private property accounts.
  3. The Executive may, in respect of that class of patients’ private property accounts consisting of all patients’ private property accounts held at the Patients’ Private Property Accounts Central Unit, Tullamore, impose a weekly administrative charge of not more than 25% of the total gross investment income earned by that class during the week to which the charge relates. EXPLANATORY NOTE (This note is not part of the Instrument and does not purport to be a legal interpretation). These Regulations are made under section 20 of the Health (Repayment Scheme) Act 2006 and provide for the Health Service Executive (HSE) to impose a charge for administering Patient Private Property Accounts. Patient Private Property Accounts are operated by the HSE to support patients in managing their financial affairs and assisting them in dealing with various aspects of daily living. The regulations allow 25% of interest earned on these accounts be retained to offset the costs of administering these accounts. These administration costs relate to the costs associated with the central investment unit established to invest funds and costs associated with the external audit of these accounts. The charge will not apply to locally held accounts, the costs of which will be met by the HSE.
