No. 724 of 2007 ROAD TRAFFIC (LICENSING OF LEARNER DRIVERS) (No. 2) REGULATIONS 2007 Notice of the making of this Statutory Instrument was published in “Iris Oifigiúil” of 2nd November, 2007. I, NOEL DEMPSEY, Minister for Transport, in exercise of the powers conferred on me by section 42 of the Road Traffic Act 1961 (No. 24 of 1961) and the National Roads and Road Traffic (Transfer of Departmental Administration and Ministerial Functions) Order 2002 ( S.I. No. 298 of 2002 ) (as adapted by the Public Enterprise (Alteration of Name of Department and Title of Minister) Order 2002 ( S.I. No. 305 of 2002 ), hereby make the following regulations: 1.
(1)These Regulations may be cited as the Road Traffic (Licensing of Learner Drivers) (No. 2) Regulations 2007.
(2)These Regulations come into operation on 30 October 2007 and cease to have effect on 30 June
- The amendment effected by Regulation 2(b)(i) and (iii) of the Road Traffic (Licensing of Learner Drivers) Regulations 2007 ( S.I. No. 719 of 2007 ) to Regulation 17
(6)of the Road Traffic (Licensing of Drivers) Regulations 2006 ( S.I. No. 537 of 2006 ) does not apply, until 30 June 2008, to a person who holds or held a provisional licence for a category of vehicle in force at any time within the 5 year period before 30 October 2007 in relation to that category and, accordingly, subparagraphs (a) and (c) of paragraph
(6)of that Regulation as they stand before their amendment apply to such a holder. GIVEN under my Official Seal, 29 October 2007 NOEL DEMPSEY. Minister for Transport. EXPLANATORY NOTE (This note is not part of the Instrument and does not purport to be a legal Interpretation.) These regulations provide that the amendments effected by Regulation 2(b)(i) and (iii) of the Road Traffic (Licensing of Learner Drivers) Regulations 2007 ( S.I. No. 719 of 2007 ) to Regulation 17
(6)of the Road Traffic (Licensing of Drivers) Regulations 2006 ( S.I. No. 537 of 2006 ) do not apply, until 30 June 2008, to a person who holds or held a provisional licence for a category of vehicle in force at any time within the 5 year period before 30 October 2007, where the person has a learner permit (provisional licence) in that category.
