I, MICHEÁL MARTIN, Minister for Enterprise, Trade and Employment, in exercise of the powers conferred on me by section 3 of the European Communities Act 1972 (No. 27 of 1972), for the purpose of giving effect to Directive 96/73/EC of the European Parliament and of the Council of 16 December 1996 1 , and Commission Directive 2006/2/EC of 6 January 2006 2 hereby make the following Regulations— 1. These Regulations may be cited as the European Communities (Quantitative Analysis of Binary Textile Fibre Mixtures) Regulations 2007. 2. In these Regulations “Directive” means Directive 96/73/EC of the European Parliament and of the Council of 16 December 1996 1 , as amended by Commission Directive 2006/2/EC of 6 January 2006 2. 3. A word or expression which is used in these Regulations and which is also used in the Directive has, unless the context otherwise requires, the same meaning in these Regulations as it has in the Directive. 4. The Director of Consumer Affairs shall arrange to have tests (“official tests”) carried out for the purposes of these Regulations. 5. Annexes I and II to the Directive, on methods for the quantitative analysis of certain binary textile fibre mixtures, including the preparation of test samples and test specimens, shall be applied in all official tests arranged to be carried out by the Director to determine the composition of textile products placed on the market. 6. Any laboratory responsible for the testing of binary mixtures for which there is no uniform method of analysis at Community level shall determine the composition of such mixtures by using any valid method at its disposal, indicating in the analysis report the result obtained and, insofar as this is known, the degree of accuracy of the method used. 7. Regulations 4 and 8 of the European Communities (Quantitative Analysis of Binary and Ternary Fibre Mixtures) Regulations 1990 ( S.I. No. 275 of 1990 ) are hereby revoked. EXPLANATORY NOTE (This note is not part of the instrument and does not purport to be legal interpretation). This Statutory Instrument transposes Directive 96/73/EC of the European Parliament and of the Council of 16 December 1996 and is a companion to Directive 96/74/EC of the European Parliament and of the Council of 16 December 1996. Directive 96/74/EC covers the names and definitions of various textile products whereas Directive 96/73/EC covers the methods for testing these textiles.
