I, BRENDAN SMITH, Minister for Agriculture, Fisheries and Food, in exercise of the powers conferred on me by section 3 of the European Communities Act 1972 (No. 27 of 1972), for the purpose of giving effect to Council Directive No. 2008/72/EC of 15 July 2008 1 , hereby make the following Regulations— 1. These Regulations may be cited as the European Communities (Market-ing of Vegetable Propagating and Planting Material, other than Seed) (Amen-dment) Regulations 2008. 2. A reference in Regulations made under the European Communities Act 1972 to Council Directive No. 92/33/EEC of 28 April 1992 is construed and has effect as if the reference is a reference to Council Directive No. 2008/72/EC of 15 July 2008 (“codified Directive”) or the equivalent provision of the codified Directive and the reference is to be read in accordance with correlation table at Annex IV to the codified Directive. 3. Nothing in these Regulations purports to create a criminal offence, or to revive criminal proceedings, under Regulations to which Regulation 2 refers, in respect of an event that occurred before the making of these Regulations.
