No. 580 of 2008 INFECTIOUS DISEASES MAINTENANCE ALLOWANCE (INCREASED PAYMENT) REGULATIONS, 2008 Notice of the making of this Statutory Instrument was published in “Iris Oifigiúil” of 6th January, 2009. The Minister for Health and Children, in exercise of the powers vested in her by Section 5 and Section 44 (sub-section 5) of the Health Act, 1947 , (No. 28 of 1947), as adapted by the Health (Alteration of Name of Department and Title of Minister) Order (S.I. 308 of 1997), hereby makes the following regulations— Citation 1. These regulations may be cited as the Infectious Diseases Maintenance Allowance (Increased Payment) Regulations, 2008. Rate of Payment 2. Where a person is or becomes entitled to payment under sub-section
(3)of Section 44 of the Health Act, 1947 in accordance with the Infectious Diseases (Maintenance Allowances) Regulations, 2008 ( S.I. No. 836 of 2007 ), any amount so payable, in respect of the week commencing 1st December, 2008 to or in respect of the person or his/her dependants shall be increased by a sum equal to 100 per cent of that amount or €30.00 whichever is the greater. EXPLANATORY NOTE (This note is not part of the instrument and does not purport to be a legal interpretation.) The effect of these Regulations is to increase, in respect of the week commencing 1st December, 2008, the maximum weekly rate of maintenance allowance payable under Section 44 of the Health Act 1947 by a sum equal to one hundred per cent of that amount or €30.00, whichever is the greater.
