No. 438 of 2009 PRISON (DISCIPLINARY CODE FOR OFFICERS) (AMENDMENT) RULES 2009 Notice of the making of this Statutory Instrument was published in “Iris Oifigiúil” of 6th November, 2009. I, DERMOT AHERN, Minister for Justice, Equality and Law Reform, in exercise of the powers conferred on me by section 35 of the Prisons Act, 2007 (No. 10 of 2007) and with the approval of Government, hereby make thefollowing Rules. 1.

(1)These Rules may be cited as the Prison (Disciplinary Code for Officers) (Amendment) Rules, 2009.
(2)These Rules shall come into operation on the 1st day of November
  1. In these Rules, unless the context otherwise requires- “Rules of 1996” means the Prison (Disciplinary Code for Officers) Rules, 1996, Statutory Instrument No. 289 of
  2. Rule 4
(1)of the Rules of 1996 is amended by the substitution of the following for the definition of “the Minister”: “ ‘the Minister’ means the Minister for Justice, Equality and Law Reform or a person designated by him or her to perform the duties assigned to the Minister under these Rules”.
  1. Rule 11 of the of the Rules of 1996 is amended by the substitution of the following for that Rule “A decision to dismiss an officer from the Prison Service shall be made in accordance with the provisions of section 5 of the Civil Service Regulation Act, 1956 (No. 46 of 1956).” GIVEN under my Official Seal, 22 October
