No. 480 of 2009 AN CHOMHAIRLE EALAÍON STAFF SUPERANNUATION (AMENDMENT) SCHEME 2009 Notice of the making of this Statutory Instrument was published in “Iris Oifigiúil” of 8th December, 2009. WHEREAS in exercise of the powers conferred on it by Section 31 of the Arts Act 2003 (No. 24 of 2003), the Arts Council has prepared and submitted to me a scheme for the granting of superannuation benefits to or in respect of its staff; Now I, MARTIN CULLEN, Minister for Arts, Sport and Tourism, pursuant to Section 31 of the Arts Act 2003 (No. 24 of 2003), with the consent of the Minister for Finance, herby approve the superannuation scheme set out hereunder:— Short Title 1. This Scheme may be cited as the An Chomhairle Ealaíon Staff Superannuation (Amendment) Scheme 2009. Commencement 2. The Scheme shall be deemed to have commenced with effect from the 1st January 1975 which shall be known as the Date of Commencement. Definitions 3. “the Main Scheme” means the An Chomhairle Ealaíon Superannuation Fund Trust Deed/Rules and Schedule I of the Rules (scheme A), dated 13th July 2001, as amended by the First Schedule of the Deed of Amendment in respect of the An Chomhairle Ealaíon Superannuation Fund dated 8th October 2009. “the Schedule” means the Schedule attached to this Statutory Instrument. Amendments to the Main Scheme 4. The superannuation provisions contained in the documents listed in the Schedule will form part of the Main Scheme. The implementation dates of the provisions will be as set out in the respective documents. In the event of any conflict between provisions in the documents in the Schedule and other provisions in the Main Scheme, the provisions in the Schedule shall apply. Repeal 5. The An Chomhairle Ealaíon Staff Superannuation Scheme 1976 signed 5th February 1976 as amended by the An Chomhairle Ealaíon Staff Superannuation (Amendment) Scheme 1979 signed 1st March 1979 is hereby repealed. This scheme may be cited as An Chomhairle Ealaíon (Amendment) Scheme 2009 which repeals the An Chomhairle Ealaíon Staff Superannuation Scheme 1976 signed 5th February 1976 as amended by the An Chomhairle Ealaíon Staff Superannuation (Amendment) Scheme 1979 signed 1st March 1979, and provides for amendment to the An Chomhairle Ealaíon Staff Superannuation Scheme under Section 31 of the Arts Act 2003 , in accordance with the provisions contained in the documents listed in the Schedule.
