I, MARY WALLACE, Minister of State at the Department of Health and Children in exercise of the powers conferred on me by section 43

(4)(c) (inserted by section 14 of the Public Health (Tobacco) (Amendment) Act 2004 (No. 6 of 2004)) of the Public Health (Tobacco) Act 2002 (No. 6 of 2002), and the Health and Children (Delegation of Ministerial Functions) (No. 4) Order 2008 ( S.I. No. 482 of 2008 ) hereby make the following regulations:
  1. These Regulations may be cited as the Public Health (Tobacco) (Retail Sign) Regulations
  3. These Regulations come into operation on 1 July
  5. The sign set out in the Schedule is prescribed for the purposes of section 43
(4)(c) (inserted by section 14 of the Public Health (Tobacco) (Amendment) Act 2004 (No. 6 of 2004)) of the Public Health (Tobacco) Act 2002 (No. 6 of 2002). 4.
(1)The sign prescribed in Regulation 3 shall— (
  1. a)contain the text set out in the Schedule, (
  2. b)be printed on white paper or card board, and (
  3. c)conform to the dimensions, type-face colour, font and point size of the sign set out in Schedule.
(2)The name and the retail register number, when available, of the retailer and the address of the premises concerned shall be inserted where indicated on the sign prescribed in Regulation 3 and set out in the Schedule.
(3)Attention shall not be drawn to such sign by means of light, sound or any other means. These Regulations may be cited as the Public Health (Tobacco) (Retail Sign) Regulations 2009. With effect from 1 July 2009 section 43
(4)(c) (inserted by section 14 of the Public Health (Tobacco) (Amendment) Act 2004 (No. 6 of 2004)) of the Public Health (Tobacco) Act 2002 (No. 6 of 2002) requires that a sign as prescribed in these Regulations be displayed at a premises where tobacco products are sold by retail.
