(15)and 16 of Regulation (EC) No. 661/2009 of the European Parliament and of the Council of 13 July 2009 6 , in so far as those Directives and Regulations apply to the type approval of motor vehicles and their trailers, components, systems and separate technical units specified in Directive 2007/46/EC 1 , hereby make the following regulations:

1. These Regulations may be cited as the European Communities (Road Vehicles: Type-Approval) (Amendment) Regulations
3. The European Communities (Road Vehicles: Type-Approval) Regulations 2009 ( S.I. No.158 of 2009 ) are amended— (a) in Regulation 25 by substituting for paragraph

(4)the following: “(

1. a)A person who commits an offence under Regulation 11(
2. b)is liable on summary conviction to a fine not exceeding €5,000. (

EXPLANATORY NOTE (This note is not part of the Instrument and does not purport to be a legal interpretation) The European Communities (Road Vehicles: Type-Approval) Regulations 2009 ( S.I. No.158 of 2009 ) gave effect to Directive 2007/46/EC (the Framework Directive) and to each of the separate Directives that individually regulate many components, systems and separate technical units of relevant vehicles, in so far as those Directives relate to the type-approval of certain motor vehicles and of certain components, systems and separate technical units. S.I. No.158 of 2009 applies principally to: •new vehicles (including certain special-purpose vehicles) of categories M1, M2, M3, N1, N2, N3, O1, O2, O3, O4, whether the relevant vehicle is complete incomplete or completed and, from staggered dates until 2014, existing vehicles of those categories also; and •specified components, systems and separate technical units of such vehicles. Schedule 1 of S.I. No.158 of 2009 contains a list of the separate Directives (as amended) and Schedule 6 contains a list of Regulations that amended the Framework Directive. S.I. 158 of 2009 is now being updated by substituting new schedules for Schedules 1 and 6. The new Schedule 1 includes amendments pursuant to the following: •Directive 2009/19/EC amending Directive 72/245/EEC relating to the radio interference (electromagnetic compatibility) of vehicles •Directive 2008/89/EC amending Directive 76/756/EEC concerning the installation of lighting and light-signalling devices on motor vehicles and their trailers •Directive 2009/1/EC amending Directive 2005/64/EC relating to the type-approval of motor vehicles with regard to their reusability, recyclability and recoverability •EC Regulation 715/2007 as amended by 692/2008 and 595/2009 introduces the required administrative procedures into Directive 70/220/EEC relating to emissions •EC Regulation 715/2007 as amended by 692/2008 and 595/2009 introduces the required administrative procedures into Directive 72/306/EEC relating to diesel smoke •EC Regulation 595/2009 introduces the required administrative procedures into Directive 80/1269/EEC relating to the engine power of motor vehicles •EC Regulation 595/2009 introduces the required administrative procedure into Directive 2005/55/EC relating to emissions from heavy duty vehicles •Directive 71/127/EEC deleted (repealed by 2003/97/EC) •Directive 2005/66/EC deleted (repealed by EC Regulation 78/2009) •Directive 2003/102/EC deleted (repealed by EC Regulation 78/2009) The new Schedule 6 includes amendments to the Framework Directive pursuant to the following; •Regulation (EC) No. 385/2009 replacing Annex IX to Directive 2007/46/EC •Regulation (EC) No. 595/2009 on type-approval of motor vehicles and engines with respect to emissions from heavy duty vehicles (Euro VI) and on access to vehicle repair and maintenance information, amending Directive 2007/46/EC •Article 18 of Regulation (EC) No. 661/2009 concerning type-approval requirements for the general safety of motor vehicles, their trailers and systems, components and separate technical units It must be noted that EC Regulations do not need transposition into Irish law, as they are directly binding throughout the Member States of the European Union. However, specific Articles of EC Regulations 715/2007, 78/2009, 79/2009, 595/2009 and 661/2009 are given further effect by these Regulations in relation to penalties and in relation to their timetable of applicability to the type approval of motor vehicles, their trailers and systems, components and separate technical units. Annex IV of Council Directive 2007/46/EC of 5 September 2007 (as amended) on the type approval of motor vehicles and their trailers (O.J. L263 of 9.10.2007, p. 1) provides a comprehensive applicable list of EC Regulations for motor vehicles and their trailers. In addition, small amendments are made to S.I. 158 of 2009 in respect of the summary and indictable prosecutions which may be taken against those who commit an offence under these Regulations. 1 O.J.
