I, MARY HARNEY, Minister for Health and Children, in exercise of the powers conferred on me by section 3 of the Misuse of Drugs Act 1977 (No. 12 of 1977) (as adapted by the Health (Alteration of Name of Department and Title of Minister) Order 1997 ( S.I. No. 308 of 1997 )), hereby order as follows:— Citation 1. This Order may be cited as the Misuse of Drugs (Exemption) (Amendment) Order 2010. Interpretation 2. In this Order the “Principal Order” means the Misuse of Drugs (Exemption) Order 1988 ( S.I. No. 326 of 1988 ) as amended by the Misuse of Drugs (Exemption) (Amendment) Order 1993 ( S.I. No. 339 of 1993 ) and the Misuse of Drugs (Exemption) (Amendment) Order 2006 ( S.I. No. 54 of 2006 ). Amendment of Part 1 of the Schedule to the Principal Order 3. Part 1 of the Schedule to the Principal Order is amended— (
- a)in paragraph 1— (
- i)by inserting after “Alprazolam” the word “Aminorex.”, (
- ii)by inserting after “Bromazepam” the word “Brotizolam.”, (iii) by inserting after “Mefenorex” the word “Mesocarb.”, and (
- iv)by inserting after “Triazolam” the word “Zolpidem.”. (
- b)by substituting the following for paragraph 3:- “3. Any fungus of any kind or description, which contains psilocin or an ester of psilocin, where that fungus is growing uncultivated.” Revocation of Misuse of Drugs (Exemption) (Amendment) Order 2006 ( S.I. No. 54 of 2006 ) 4. The Misuse of Drugs (Exemption) (Amendment) Order 2006 ( S.I. No. 54 of 2006 ) is hereby revoked. GIVEN under my Official Seal, 11 May 2010. MARY HARNEY, Minister for Health and Children. EXPLANATORY NOTE (This note is not part of the Instrument and does not purport to be a legal interpretation). The effect of this Order is to exempt from the provisions of section 3 of the Misuse of Drugs Act 1977 (which makes the possession of controlled drugs an offence) those preparations listed in this Order.
