I, BATT O’KEEFFE, Minister for Enterprise, Trade and Innovation, in exercise of the powers conferred on me by section 3 of the European Communities Act 1972 (No. 27 of 1972) and for the purpose of giving full effect to Council Regulation (EC) No. 423/2007 of 19 April 2007 1 , as amended by Council Regulation (EU) No. 1228/2009 of 15 December 2009 2 , hereby make the following regulations: 1. These Regulations may be cited as the European Communities (Restrictive Measures) (Iran) (Amendment) Regulations 2010. 2. The European Communities (Restrictive Measures) (Iran) Regulations 2007 ( S.I. No. 616 of 2007 ) are amended— (
  4. a)by substituting the following Regulation for Regulation 2 (as amended by the European Communities (Restrictive Measures) (Iran) (Amendment) Regulations 2009 ( S.I. No. 482 of 2009 )): “2. In these Regulations ‘Council Regulation’ means Council Regulation (EC) No. 423/2007 of 19 April 20071, as amended by Council Regulation (EC) No. 618/2007 of 5 June 2007 3 , Commission Regulation (EC) No. 116/2008 of 28 January 2008 4 , Commission Regulation (EC) No. 219/2008 of 11 March 2008 5 , Council Regulation (EC) No. 1110/2008 of 10 November 2008 6 and Council Regulation (EU) No. 1228/2009 of 15 December 20092.”, and (

EXPLANATORY NOTE (This note is not part of the instrument and does not purport to be a legal interpretation). The effect of this Order is to amend the Statutory Instrument that provided for penalties for infringements of Council Regulation (EC) No. 423/2007 of 19 April 2007. The Council Regulation introduced restrictions on the export of goods and technology which could contribute to Iran’s enrichment-related, reprocessing, or heavy water-related activities, or to the development of nuclear weapon delivery systems. It also bans the provision of technical assistance, brokering services and investment related to, and the procurement of, such goods and technology from Iran. The amendments, which give effect to Council Regulation (EU) 1228/2009 provide for further prohibitions on the sale, supply or transfer of certain items that could contribute to the proliferation of sensitive nuclear activities or to the development of nuclear weapon delivery systems. 1 O.J.
