I, EAMON RYAN, Minister for Communications, Energy and Natural Resources, in exercise of the powers conferred on me by section 39 of the Electricity Regulation Act 1999 (No. 23 of 1999) (as adapted by the Communications, Marine and Natural Resources (Alteration of Name of Department and Title of Minister) Order 2007 ( S.I. No. 706 of 2007 )), having consulted with the Minister for the Environment, Heritage and Local Government, having regard for the need for public service obligations to be imposed in a non-discriminatory and transparent manner, and having, in accordance with section 39

(10)of the Act, given a draft of the following order to the persons upon which the obligation concerned is to be imposed, hereby order as follows:
  1. This Order may be cited as the Electricity Regulation Act 1999 (Public Service Obligations) (Amendment) Order
  3. In this Order— “Act of 1999” means the Electricity Regulation Act 1999 (No. 23 of 1999); “distribution” has the meaning assigned to it by section 2 of the Act of 1999; “generator” means a person licensed to generate electricity under Section 14
(1)(a) of the Act of 1999; “intermediary” has the meaning assigned to it by the Single Electricity Market Trading and Settlement Code; “Order of 2009” means the Electricity Regulation Act 1999 (Public Service Obligations) (Amendment) Order 2009 ( S.I. No. 444 of 2009 ); “the Single Electricity Market” has the meaning assigned to it by section 2 of the Electricity Regulation Act 1999 (as inserted by section 3 of the Electricity Regulation (Amendment) (Single Electricity Market) Act 2007 (No. 5 of 2007)); “Single Electricity Market Regulations” means the Electricity Regulation Act 1999 (Single Electricity Market) Regulations 2007 ( S.I. No. 406 of 2007 ); “Single Electricity Market Trading and Settlement Code” means the code of that name established pursuant to section 9BA
(1)of the Electricity Regulation Act 1999 and so designated pursuant to Regulation 5 of the Single Electricity Market Regulations, as from time to time revised, amended, supplemented or replaced; “transmission” has the meaning assigned to it by section 2 of the Act of 1999. 3. The Electricity Regulation Act 1999 (Public Service Obligations) Order 2002 ( S.I. No. 217 of 2002 ) is amended— (
  1. a)in Article 4, by substituting for paragraph (1G) (inserted by Article 3 of the Order of 2009) the following: “(1G) The period of the public service obligations to be imposed pursuant to Article 6D commences, in respect of a REFIT power purchase agreement listed in column 1 of Schedule 3, on— (
  2. a)in the case of a generator not registered in the Single Electricity Market pursuant to Regulation 5 of the Single Electricity Market Regulations, the date on which the supplier purchases output from the plant of the generator which is exported for the purposes of distribution or transmission, or (
  3. b)in the case of a generator registered in the Single Electricity Market pursuant to Regulation 5 of the Single Electricity Market Regulations and a supplier registered as the intermediary for that generator, the date on which the supplier purchases output from the plant of the generator which is exported for the purposes of transmission or distribution which date shall not be later than 31 December 2010, unless, in respect of a plant specified in column 5 of Schedule 3, the Minister has notified a later date in writing to the Commission for Electricity Regulation, to the supplier specified at that reference number in column 3 and to the generator specified at that reference number in column 4.” and (
  4. b)by substituting for Schedule 3 (inserted by Article 3 of the Order of 2009) the Schedule set out in the Schedule to these Regulations. “Schedule 3”,
