I, MARY HARNEY, Minister for Health and Children, in exercise of the powers conferred on me by section 3 of the European Communities Act 1972 (No. 27 of 1972) and for the purpose of giving effect to Commission Directive 2010/37/EU of 17 June 20101 , hereby make the following regulations— 1.

(1)These Regulations may be cited as the European Communities (Additives, Colours and Sweeteners in Foodstuffs) (Amendment) (No. 2) Regulations 2010.
(2)The collective citation “the European Communities (Additives, Colours and Sweeteners in Foodstuffs) Regulations 2000 to 2010” includes these Regulations.
  1. In these Regulations “Principal Regulations” means the European Communities (Additives, Colours and Sweeteners in Foodstuffs) Regulations 2000 ( S.I. No. 437 of 2000 ).
  2. Regulation 2
(1)of the Principal Regulations is amended— (
  1. a)in the definition of “the Directives”, by substituting— “Commission Directive 2008/60/EC7A of 17 June 2008 (as amended by Commission Directive 2010/37/EU7B of 17 June 2010)” for “Commission Directive 2008/60/EC7A of 17 June 2008” and by the addition of the following footnote— “7B OJ L 152, 18.6.2010, p. 12”, (
  2. b)by substituting for the definition of “Directive 2008/60/EC” the following— “ ‘Directive 2008/60/EC’ means Commission Directive 2008/60/EC7A of 17 June 2008) laying down specific purity criteria concerning sweeteners for use in foodstuffs (as amended by Commission Directive 2010/37/EU7B of 17 June 2010)”. EXPLANATORY NOTE (This note is not part of the Instrument and does not purport to be a legal interpretation.) These Regulations give effect to Commission Directive 2010/37/EU of 17 June 2010 amending Directive 2008/60/EC laying down specific purity criteria on sweeteners. These Regulations amend the European Communities (Additives, Colours and Sweeteners in Foodstuffs) Regulations 2000 ( S.I. No. 437 of 2000 ) in the manner specified in these Regulations.
