The District Court Rules Committee, in exercise of the powers conferred on them by section 91 of the Courts of Justice Act 1924 , section 72 of the Courts of Justice Act 1936 , section 34 of the Courts (Supplemental Provisions) Act 1961 and section 24 of the Interpretation Act 2005 , do hereby, with the concurrence of the Minister for Justice and Law Reform, make the following rules of court. No. 557 of 2010 DISTRICT COURT (SUMMONSES) RULES 2010 1.

(1)These Rules, which may be cited as the District Court (Summonses) Rules 2010, shall come into operation on the 23rd day of December 2010.
(2)These Rules shall be construed together with the District Court Rules 1997 ( S.I. No. 93 of 1997 ) and all other District Court Rules.
(3)The District Court Rules as amended by these Rules may be cited as the District Court Rules 1997 to
  1. The District Court Rules 1997 ( S.I. No. 93 of 1997 ) are amended by the substitution for rule 6 of Order 15 of the following rule: “6.
(1)In the case of every summons issued otherwise than by transmitting it by electronic means to the person who applied for it or a person acting on his or her behalf, there shall be issued with such summons one copy thereof for service upon each person to whom the summons is directed.
(2)Where a summons is issued by transmitting it by electronic means to the person who applied for it or a person acting on his or her behalf, a true copy of such summons shall be served upon each person to whom the summons is directed.” EXPLANATORY NOTE (This note is not part of the Instrument and does not purport to be a legal interpretation.) These rules substitute rule 6 of Order 15 of the District Court Rules regarding procedure for the delivery of summonses.
