The Minister for Social Protection, in exercise of the powers conferred on him by sections 4 and 241 (as amended by section 9 of the Social Welfare and Pensions Act 2009 (No. 10 of 2009)) of the Social Welfare Consolidation Act 2005 (No. 26 of 2005), hereby makes the following Regulations: Citation and construction. 1.

(1)These Regulations may be cited as the Social Welfare (Consolidated Claims, Payments and Control) (Amendment) (No. 2) (Claims) Regulations 2010.
(2)These Regulations and the Social Welfare (Consolidated Claims, Payments and Control) Regulations 2007 ( S.I. No. 142 of 2007 ) shall be construed together as one and may be cited as the Social Welfare (Consolidated Claims, Payments and Control) Regulations 2007 to
  1. Commencement.
  2. These regulations come into operation on 3 January
  3. Definitions.
  4. In these Regulations “the Principal Regulations” means the Social Welfare (Consolidated Claims, Payments and Control) Regulations 2007 ( S.I. No. 142 of 2007 ). Information to be given when making a claim.
  5. Article 181 of the Principal Regulations is amended by inserting the following sub-articles after sub-article
(1): “(1A) Without prejudice to the generality of sub-article
(1), a person who makes a claim for jobseeker’s benefit or jobseeker’s allowance shall, on being requested by an officer of the Minister, who has formed the opinion that the furnishing of the information specified in sub-article (1B) would assist in— (
  1. a)determining that person’s claim for jobseeker’s benefit or jobseeker’s allowance, or (
  2. b)in assessing the training, education or development needs appropriate to that person’s personal circumstances, provide the information specified in sub-article (1B). (1B) For the purposes of sub-article (1A), an officer of the Minister may request a person who makes a claim for jobseeker’s benefit or jobseeker’s allowance to provide the following details in respect of that person— (
  3. a)any claims for jobseeker’s payments made in the 5 years immediately before that request has been made, (
  4. b)current employment or last employment held, if any, and details of the gross weekly earnings in that employment, (
  5. c)any periods of employment under a scheme administered by An Foras Áiseanna Saothair and known as Community Employment in the 5 years immediately before that request has been made, (
  6. d)the highest level of education completed, (
  7. e)any apprenticeship training completed, (
  8. f)address and size of location, (
  9. g)access to private means of transport (e.g. car, van, motorcycle), (
  10. h)access to public transport options, including private bus and coach operators, (
  11. i)efforts undertaken to seek employment, (
  12. j)literacy and numeracy difficulties, (
  13. k)general state of health, (
  14. l)proficiency in the English language, (
  15. m)date of birth, (
  16. n)country of birth, (
  17. o)marital status, (
  18. p)family composition, (
  19. q)gross weekly earnings of spouse, if any, (
