I, PAT RABBITTE, Minister for Communications, Energy and Natural Resources, in exercise of the powers conferred on me by section 285A (inserted by section 46 of the Finance Act 2008 (No. 3 of 2008)) of the Taxes Consolidation Act 1997 (No. 39 of 1997), with the approval of, and after consultation with, the Minister for Finance, hereby order as follows: 1.

(1)This Order may be cited as the Taxes Consolidation Act 1997 (Accelerated Capital Allowances for Energy Efficient Equipment) (Amendment) (No. 3) Order 2011.
(2)The collective citation, “the Taxes Consolidation Act 1997 (Accelerated Capital Allowances for Energy Efficient Equipment) Orders 2008, 2009, 2010 and 2011”, includes this Order.
  1. In this Order “Principal Order” means the Taxes Consolidation Act 1997 (Accelerated Capital Allowances for Energy Efficient Equipment) Order 2008 ( S.I. No. 399 of 2008 ).
  2. Schedule 1 of the Principal Order is amended by substituting the following for Part 13 of that Schedule: “Part 13Category: Heating and Electricity Provision Technology: Co-generation Co-generation is defined as highly energy efficient equipment which can simultaneously generate a combination of heat, cooling energy and usable electrical power in a single thermodynamic process and which is intended primarily for on-site use. Co-generation Equipment is considered to include the following: Combined Heat and Power Combined Heat and Power (CHP) is the simultaneous generation of heat and power in a single process. Tri-generation Tri-generation is the simultaneous generation of heat, cooling and power in a single process whereby the cooling effect is obtained through the CHP generated heat by means of an absorption chiller. Co-generation Eligibility Criteria: In order to be included on the ACA Specified List, a Co-generation product must meet all of the relevant requirements listed below. Note: Supporting documentation that clearly demonstrates ACA compliance according to the conditions below will be required as part of the ACA checking process. Detailed information on the types of documents accepted can be found in the separate Supporting Documentation guidelines. General Eligibility Criteria (Applicable to all Co-generation equipment) No. Condition
  3. All equipment and/or components must be CE marked as required by the specific EU directive(s).
  4. Appropriate operating and maintenance manuals must be available for the end-user as part of the main contract of sale in order to optimise the achievement of any potential efficiency improvements. CHP Specific Eligibility Criteria (To be met in addition to the general eligibility criteria) No. Condition
  5. The CHP unit must be a packaged unit with the power generation section and heat recovery section contained within a single enclosure, and should consist of a single prime mover.
  6. Units must have a minimum overall efficiency (thermal + electricity) greater than or equal to 81%, calculated on a gross calorific value basis. Efficiency must be tested by, OR have the testing approved by an accredited body to EITHER:
  7. standard EU directive 2004/8/EC or equivalent, OR
  8. standard EN 15316-4-4
  9. The unit must have installed software to record levels of electricity and heat generated over a running period.
  10. The CHP Unit must include one main heat output system i.e. a system recovering heat from the prime mover and the exhaust gasses, and must have no inbuilt facility to dump heat. Tri-generation specific Eligibility Criteria: (To be met in addition to the general eligibility criteria) No. Condition
  11. The heat & power element of the Tri-generation system must comply with the eligibility criteria for CHP units.
  12. The Absorption chiller must use the CHP heat source as its primary energy input. (The chiller should be an “indirect fired” Absorption chiller).
  13. The Absorption chiller must have a minimum COP of 0.7
  14. The units must have installed software to record levels of cooling achieved. ”.
  15. Schedule 1 of the Principal Order is amended by substituting the following for Part 14 of that Schedule: “Part 14Category: Heat and Electricity Provision Technology: Wind Turbine A Wind Turbine is defined as advanced equipment which converts the winds kinetic energy into rotary mechanical energy, which is then used for electricity generation primarily for on-site use. Wind turbine systems are considered to include the following: A turbine and supporting structure, the primary element of the wind turbine system, but may also include control and energy storage systems. Wind Turbine Eligibility Criteria: In order to be included on the ACA Specified List a Wind Turbine must meet all of the relevant requirements listed below. Note: Supporting documentation that clearly demonstrates ACA compliance according to the conditions below will be required as part of the ACA checking process. Detailed information on the types of documents accepted can be found in the separate Supporting Documentation guidelines. Wind Turbine — Specific Eligibility Criteria (Applicable to all wind turbine equipment) No. Condition
  16. All equipment and/or components must be CE marked as required by the specific EU directive(s).
  17. Must have a rating for Microgen of less than 50kW. There are no upper size limits for other programmes within the ACA
  18. The wind turbine must comply with, and have been tested according to, the appropriate European standard(s), or scientific equivalent, applicable to its size and type.
  19. Appropriate operating and maintenance manuals must be available for the end-user as part of the main contract of sale in order to optimise the achievement of any potential efficiency improvements.
  20. Manufacturer approved masts for wind turbines must provide a minimum height from the centre of the hub vertically to the base plate or ground (whichever is lesser) of 6m. ”.
  21. Schedule 1 of the Principal Order is amended by substituting the following for Part 18 of that Schedule: “Part 18Category: Heat and Electricity Provision Technology: Photovoltaic Systems A Photovoltaic (PV) System is defined as advanced equipment which efficiently converts solar energy into electrical energy primarily for on-site use. Photovoltaic Systems are considered to include the following: The module and supporting structure, the primary element of the photovoltaic system but may also include control systems (e.g. tracking mechanism and solar concentrator) and energy storage systems. Photovoltaic Systems Eligibility Criteria: In order to be included on the ACA Specified List a Photovoltaic System must meet all of the relevant requirements listed below. Note: Supporting documentation that clearly demonstrates ACA compliance according to the conditions below will be required as part of the ACA checking process. Detailed information on the types of documents accepted can be found in the separate Supporting Documentation guidelines. Photovoltaic module — Specific Eligibility Criteria (Applicable to all photovoltaic system equipment) No. Condition
  22. All equipment and/or components must be CE marked as required by the specific EU directive(s).
  23. Photovoltaic modules must comply with the relevant standards (design qualification and type approval) and outputs specified in Table 1.(Photovoltaic module peak power output per m2 must be quoted in terms of Standard Test Conditions (STC): Irradiance of 1000W/m2; spectrum AM 1.5G; cell temperature 250C. The area is the gross area of the panel)
  24. Appropriate operating and maintenance manuals must be available for the end-user as part of the main contract of sale in order to optimise the achievement of any potential efficiency improvements. Schedule 1 of the Principal Order is amended by inserting the following: “Part 50 Category: Heating and Electricity Provision Technology: Inverters for Photovoltaic and Wind Turbine Systems A high efficiency Inverter is defined as a device that converts direct current electricity into alternating current electricity. Typically an inverter is used in a system to convert the output of a renewable energy device such as a solar photo-voltaic array, or a wind generator into an output suitable to connect the system to the main electrical supply Inverter Eligibility Criteria: In order to be included on the ACA Specified List, the specific inverter equipment must meet all of the relevant requirements set out below. Note: Supporting documentation that clearly demonstrates ACA compliance according to the conditions below will be required as part of the ACA checking process. Detailed information on the types of documents accepted can be found in the separate Supporting Documentation guidelines. No. Condition 1 Must have a power rating greater than 180W 2 Inverter must be of a Grid-tie type (also known as grid interactive, and also known as synchronous inverter) and output must be pure sine wave. 3 Inverter must be compliant with the requirements of EN 50438 with the specific Irish protection settings as shown in Table 1 below. 4 All equipment and/or components must be CE marked as required by the specific EU directive(s). 5 Inverter efficiency plots must be available for the end user as part of the main contract of sale and shall show the efficiency of the inverter at the various stages of load from 1-100%. Units must have a peak efficiency no less than 95% 6 Appropriate operating & maintenance manuals must be available for the end-user as part of the main contract of sale in order to optimise the achievement of any potential efficiency improvements. Table 1: Micro-generation Interface settings for Republic of Ireland All type-testing must be carried out with these settings on board. ROCOF [where used] 0,4 Hz/s 0,5 s Vector Shift [where used] 6 degrees 0,5 s Part 51 Category: Heating and Electricity Provision Technology: Solar Thermal Collectors Solar thermal collectors are defined as renewable energy equipment which transforms solar radiation directly into thermal energy. Solar thermal collectors are considered to include the following: Flat Plate Collectors Solar thermal collector which has its absorber laid in a box, insulated at the rear and sides, and with a transparent cover on top. The heat transfer media can be water (with or without antifreeze) or air. Evacuated Tube Collectors Solar thermal collector which constitutes a series of tubes that contain an absorber area and into which vacuum is created to provide insulation. The heat transfer media is typically water (with or without antifreeze). Solar Thermal Collectors Eligibility Criteria: In order to be included on the ACA Specified List the specific solar thermal collector equipment must meet all of the relevant requirements set out below. Note: Supporting documentation that clearly demonstrates ACA compliance according to the conditions below will be required as part of the ACA checking process. Detailed information on the types of documents accepted can be found in the separate Supporting Documentation guidelines. Specific Eligibility Criteria (Applicable to all solar thermal collector equipment) No. Condition
  26. The solar thermal collector must be certified under and listed on the European Solar Keymark database as a collector or as a system. 2 Annual power output per m2 is defined byq = (n0*G — a1*dT — a2*dT2) [W]

  28. Appropriate operating & maintenance manuals must be available to the end-user in order to optimise the achievement of any potential energyefficiency gains. Part 52 Category: Refrigeration and Cooling Technology: Heat Pumps Heat Pumps are defined as equipment that is designed to transfer heat from a heat source (such as ground, water or ambient air) to a heat sink (such as indoor air or a water-based heating system) using a refrigeration system. Heat Pump equipment is considered to include the following: Air-source Heat Pumps Air-to-Water heat pumps are products that are specifically designed to transfer heat from the air outside a building to a water-based heating system by means of an electrically driven refrigeration system. Such heat pumps may also provide cooling by reversing the direction of the refrigerant flow. Air-to-water heat pumps can be split1 or packaged units2 Air–to-Air heat pumps are products that are specifically designed to transfer heat from the air outside a building to the air inside a building by means of an electrically driven or gas-fired internal combustion engine refrigeration system. Such heat pumps may also provide cooling by reversing the direction of the refrigerant flow. Air-to-water heat pumps can be split1 or packaged units
  29. Air-to-Air heat pumps can also incorporate variable refrigerant flow (VRF) which is where the flow of refrigerant is automatically adjusted so that the heat delivered is matched to the demand. 1 Split type heat pumps have separate heat collection and rejection units for each space known as ‘indoor’ and ‘outdoor’ units. The ‘indoor’and ‘outdoor’ units are specifically designed to be connected together during installation by refrigerant pipe work to form a single functional unit. 1 Packaged type heat pumps are single factory assembled units that incorporate all the elements of the refrigeration system and air distribution mechanisms for space heating. Ground Source Heat Pumps Brine-to-Water heat pumps are products that are specifically designed to transfer heat from the ground to a water-based heating system by means of an electrically-operated refrigeration system. The heat is collected from the ground by circulating a solution of water and anti-freeze (known as ‘brine‘) through a buried, closed-loop, ground heat exchanger. Such heat pumps may also provide cooling by reversing the direction of the refrigerant flow. Water-Source Heat Pumps Are products that are specifically designed to transfer heat from water (in an internal water loop) into the air within the space to be heated by means of an electrically-operated refrigeration system. Such heat pumps may also provide cooling by reversing the direction of the refrigerant flow. Water-source heat pumps can also incorporate variable refrigerant flow (VRF) and are designed to automatically adjust the flow of refrigerant so that the heat delivered is matched to the demand. Heat Pump Dehumidifiers Heat pump dehumidifiers are products that are specifically designed to remove water vapour from moist air using an electrically driven refrigeration system. They re-circulate the indoor moist air over the evaporator of the refrigeration system which cools the air and causes the water vapour in the air to condense. The resulting condensate is then drained away. These high efficiency products recover both sensible and latent heat released during dehumidification, and use it to heat the air as it leaves the product or for other useful purposes, such as water heating. Heat Pumps Eligibility Criteria: In order to be included on the ACA Specified List, the specific Heat Pumps equipment must meet all of the relevant requirements set out below. Note: Supporting documentation that clearly demonstrates ACA compliance according to the conditions below will be required as part of the ACA checking process. Detailed information on the types of documents accepted can be found in the separate Supporting Documentation guidelines. General Eligibility Criteria (Applicable to all Heat Pump equipment) No. Condition
  30. All equipment and/or components must be CE marked as required by the specific EU directive(s).
  31. All heat pumps must be designed for, and include fittings for permanent installation. Air-Source & Water-Source Heat Pump specific Eligibility Criteria (To be met in addition to the general eligibility criteria) No. Condition
  32. Incorporate an electrically or gas-fired internal combustion engine-driven refrigeration system.
  33. Meet the performance criteria set out in Table 1 below for: Coefficient of Performance (COP) across the range of connected capacities and including 100% (full) load in heating mode. Energy Efficiency Ratio (EER) across the range of connected capacities and including 100% (full) load in cooling mode, where the product is designed to provide cooling. Ground-Source Heat Pump specific Eligibility Criteria (To be met in addition to the general eligibility criteria) No. Condition
  34. Incorporate an electrically or gas-fired internal combustion engine-driven refrigeration system.
  35. Be designed to use an indirect, closed-loop ground heat exchanger.
  36. Meet the performance criteria set out in Table 1 below for: Coefficient of Performance (COP) across the range of connected capacities and including 100% (full) load in heating mode. Energy Efficiency Ratio (EER) across the range of connected capacities and including 100% (full) load in cooling mode, where the product is designed to provide cooling. Heat Pump Dehumidifiers specific Eligibility Criteria (To be met in addition to the general eligibility criteria) No. Condition
  37. Incorporate an electrically driven refrigeration system that is designed to remove water vapour from the surrounding atmosphere, as the air is recirculated through the product.
  38. Recover both sensible and latent heat released during dehumidification, and use it to heat the air as it leaves the product and/or for other useful purposes (such as water heating).
  39. Incorporate a control system that monitors the relative humidity of the surrounding atmosphere, and automatically switches off dehumidification, or modulates the rate of dehumidification, when the relative humidity falls below a preset value.
  40. Have a dehumidification capacity that is greater than or equal to () 0.625 litres per hour.
  41. Not be designed to be connected to compressed air systems.
  42. Have a dehumidification efficiency ratio (DER) equal to or greater than the thresholds set out in Table 2 below, which depend on the dehumidification capacity (C) of the product.
