AmendmentsLeasuithe Download PDF Íoslódáil PDF Notice of the making of this Statutory Instrument was published in “Iris Oifigiúil” of 4th November, 2011. WHEREAS section 91 of the Finance Act 2004 (No. 8 of 2004) makes provision for the carry over from one year to another of any unspent Exchequer capital allocations, up to a maximum of 10 per cent of the capital allocation by Vote; AND WHEREAS the Minister for Finance made a determination for the purposes of section 91
(2)of that Act in respect of certain undischarged appropriations by reference to the capital supply services and purposes included in a Vote referred to in Schedule 2 to the Appropriation Act 2010 (No. 35 of 2010); AND WHEREAS there is set out in Schedule 2 to the Appropriation Act 2010 the sums deferred into the year ending 31 December 2011 and the related Votes and Titles in respect of each of the sums concerned; AND WHEREAS, pursuant to section 91
(4)(d) of that Act, the Finance Act 2004 (Section 91) (Deferred Surrender to Central Fund) Order 2011 (S.I. 179 of 2011) was laid before Dáil Éireann and a resolution approving of the draft was passed by Dáil Éireann in the financial year immediately following the financial year in respect of which the undischarged appropriations concerned relate; AND WHEREAS the said Order was made by the Minister for Finance on 31 March 2011; AND WHEREAS the said section 91
(4)makes provision for the Minister for Finance to amend the aforementioned order; AND WHEREAS the functions of the Minister for Finance under the said section 91 have been transferred to the Minister for Public Expenditure and Reform pursuant to the Finance (Transfer of Departmental Administration and Ministerial Functions) (No. 2) Order 2011 ( S.I. No. 140 of 2011 ); AND WHEREAS, pursuant to paragraph (d) of the said section 91
(4), an amending order has been laid before Dáil Éireann and a resolution approving of the draft has been passed by Dáil Éireann; NOW, the Minister for Public Expenditure and Reform, in exercise of the powers conferred on him by section 91
(4)of the Finance Act 2004 and the Finance (Transfer of Departmental Administration and Ministerial Functions) (No. 2) Order 2011, hereby makes the following order:
- This Order may be cited as the Finance Act 2004 (Section 91) (Deferred Surrender to Central Fund) (Amendment) Order
- The Schedule to the Finance Act 2004 (Section 91) (Deferred Surrender to Central Fund) Order 2011 (S.I. 179 of 2011) is amended by substituting— “ 32 For the salaries and expenses of the Office of the Minister for Transport, Tourism and Sport including certain services administered by that Office, for payment of certain grants, grants-in-aid and certain other services. H.1 Grants for Sporting Bodies and the Provision of Sports and Recreational Facilities (Part Funded by the National Lottery) €5,000,000 Total under Vote No. 32 €5,000,000 ” for “ 35 For the salaries and expenses of the Office of the Minister for Tourism, Culture and Sport, including certain services administered by that Office, and for payment of certain subsidies, grants and grants-in-aid. C.1 Grants for Sporting Bodies and the Provision of Sports and Recreational Facilities (Part Funded by the National Lottery) €5,000,000 Total under Vote No. 35 €5,000,000 ”.
