I, JAMES REILLY, Minister for Health, in exercise of the powers conferred on me by section 3 of the European Communities Act 1972 (No. 27 of 1972), for the purpose of giving further effect to Directive 2001/37/EC of the European Parliament and of the Council of 5 June 20011 , hereby make the following regulations: 1. These Regulations may be cited as the European Communities (Manufacture, Presentation and Sale of Tobacco Products) (Amendment) Regulations 2011. 2. The European Communities (Manufacture, Presentation and Sale of Tobacco Products) Regulations 2003 ( S.I. No. 425 of 2003 ) are amended by revoking Regulation 5 and Schedule 1 with effect from: (
  4. a)1 February 2013, in respect of tobacco products placed on the market in the State on or after 1 February 2013; (

EXPLANATORY NOTE (This note is not part of the Instrument and does not purport to be a legal interpretation). These Regulations may be cited as the European Communities (Manufacture, Presentation and Sale of Tobacco Products) (Amendment) Regulations 2011 and come into effect on the date of signature. These Regulations amend the European Communities (Manufacture, Presentation and Sale of Tobacco Products) Regulations 2003 ( S.I. No. 425 of 2003 ). The effect of these Regulations is to revoke Regulation 5 and Schedule 1 of the European Communities (Manufacture, Presentation and Sale of Tobacco Products) Regulations 2003 ( S.I. No. 425 of 2003 ) to facilitate the introduction of the combined text and photo warnings provided for in the Public Health (Tobacco) (General and Combined Warnings) Regulations 2011. These Regulations should be read in conjunction with the Public Health (Tobacco) (General and Combined Warnings) Regulations 2011.
