I, LEO VARADKAR, Minister for Transport, Tourism and Sport, in exercise of the powers conferred on me by section 18 of the Road Traffic Act 1961 (No. 24 of 1961) and section 2 of the Road Traffic Act 2006 (No. 23 of 2006) (as adapted by the Transport (Alteration of Name of Department and Title of Minister) Order 2011 ( S.I. No. 141 of 2011 ) hereby make the following regulations: 1.

(1)These Regulations may be cited as the Road Traffic (National Car Test) (Amendment) (No. 2) Regulations 2011.
(2)These Regulations come into operation on 3 January
  2. In these Regulations, “Principal Regulations” means the Road Traffic (National Car Test) Regulations 2009 (SI 567 of 2009).
  3. Regulation 6 of the Principal Regulations is amended by substituting for paragraphs
(1)and
(3)the following:
(1)Subject to paragraphs
(2)and
(3)the fee to be paid for a test certificate shall be- (
  1. a)€44.72in the case of a test certificate issued following a test of a vehicle; and (
  2. b)€22.76in the case of a test certificate issued following a re-test of a vehicle.
(3)Subject to paragraph
(5), in any case where an appointment for a test or re-test has been confirmed to the issuing authority and the vehicle is not presented for the test or re-test at the appointed time and place, the issuing authority may require payment of a fee for the issue of a test certificate being the aggregate of- (a) The relevant amount specified in paragraph
(1), and (
  1. b)in respect of an appointment for- (
  2. i)a test, €17.89 for each occasion on which the vehicle was not presented for the test at the appointed time and place for the issue of a test certificate, or (
  3. ii)a re-test, €9.35 for each occasion on which the vehicle was not presented for a re-test at the appointed time and place (other than in circumstances referred to in paragraph
