I, PHIL HOGAN, Minister for the Environment, Community and Local Government, in exercise of the powers conferred on me by Sections 10 , 14 and 53 of the Air Pollution Act, 1987 (No. 6 of 1987), hereby make the following Regulations. Citation 1.

(1)These Regulations may be cited as the Air Pollution Act, 1987 (Marketing, Sale and Distribution of Fuels) (Amendment) (No. 2) Regulations 2011.
(2)The Principal Regulations, the Air Pollution Act, 1987 (Marketing, Sale and Distribution of Fuels) (Amendment) Regulations 2000 ( S.I. No. 278 of 2000 ), the Air Pollution Act 1987 (Marketing, Sale and Distribution of Fuels) (Amendment) Regulations 2003 ( S.I. No. 111 of 2003 ), the Air Pollution Act 1987 (Marketing, Sale and Distribution of Fuels) (Amendment) Regulations 2004 ( S.I. No. 713 of 2004 ), the Air Pollution Act 1987 (Marketing, Sale and Distribution of Fuels) (Amendment) Regulations 2011 ( S.I. No. 270 of 2011 ) and these Regulations may be cited together as the Air Pollution Act, 1987 (Marketing, Sale and Distribution of Fuels) Regulations 1998 to 2011 and shall be construed together as one.   1. g)of the Air Pollution Act, 1987 (Marketing, Sale and Distribution of Fuels) Regulations 2011 ( S.I. No 270 of 2011 ) are amended— (
  2. a)In respect of the Restricted Area of Athlone by substituting for “Athlone East Rural” the following: “Athlone East and West Rural;” (
  3. b)In respect of the Restricted Area of Clonmel by the addition of the following areas in the administrative county of Waterford: “In the District Electoral Division of Kilmacomma, the townlands of:— Greenan Kilmacomma. In the District Electoral Division of St. Mary's, the townlands of:— Croan Lower Croan Upper Glennagad, Kilgainy Lower Kilgainy Upper Knocklucas Knocknagriffin Lyranearla Monacallee Poulboy Poulnagunoge Scrothea East Scrothea West Spa In the District Electoral Division of Gurteen, the townlands of:— Tikincor Lower Tikincor Upper.” GIVEN under my Official Seal, 23 December 2011. These Regulations amend the Air Pollution Act, 1987 (Marketing, Sale and Distribution of Fuels) (Amendment) Regulations 2011 ( S.I. No. 270 of 2011 ). These Regulations add an additional electoral division to the restricted area of Athlone and adds additional townlands to the restricted area of Clonmel within which the marketing, sale and distribution of bituminous coal is prohibited.
