I, JOAN BURTON, Minister for Social Protection in exercise of the powers conferred on me by section 33
(13)of the Social Welfare and Pensions Act 2010 (No. 37 of 2010), hereby order as follows:
- This Order may be cited as the Social Welfare and Pensions Act 2010 (Section 33) (Appointment Day) Order
- The 1st day of January 2012 is appointed as the appointment day for the purposes of section 33 of the Social Welfare and Pensions Act 2010 (No. 37 of 2010) in so far as it relates to the employees of An Foras designated, in accordance with section 33
(1)of that Act, in the designation in writing of the 21st day of December

- JOAN BURTON, Minister for Social Protection. EXPLANATORY NOTE (This note is not part of the Instrument and does not purport to be a legal interpretation.) Part 3 of the Social Welfare and Pensions Act 2010 , together with section 16
(6)of the Social Welfare and Pensions Act 2011 , provide for the transfer of administrative responsibility for the employment and community services of An Foras Áiseanna Saothair (FÁS) and the associated FÁS resources to the Department of Social Protection. Section 33 of the Social Welfare and Pensions Act 2010 provides for the transfer of the employees that have been designated in writing by the Minister for Social Protection, with the consent of the Minister for Education and Skills. This Order provides for the transfer to the Department of Social Protection of full-time FÁS employees who have been designated by the Minister for Social Protection under section 33
(1)of the Social Welfare and Pensions Act 2010 , with effect from 1st January 2012.
