I, LEO VARADKAR, Minister for Transport, Tourism and Sport, in exercise of the powers conferred on me by section 37 of the Road Safety Authority (Commercial Vehicle Roadworthiness) Act 2012 (No. 16 of 2012), hereby order as follows: 1. This Order may be cited as the Road Safety Authority (Commercial Vehicle Roadworthiness) Act 2012 (Conferral of Functions) Order 2013. 2. This Order comes into operation on 27th March 2013. 3. The functions of the Minister for Transport, Tourism and Sport under sections 5
(1), 9
(1)and
(2), 11 (other than subsection
(2)), 12 to 15 , 16
(2), 17 to 22 , 24 and 33 of the Road Safety Authority (Commercial Vehicle Roadworthiness) Act 2012 (No. 16 of 2012) are conferred on the Road Safety Authority. EXPLANATORY NOTE (This note is not part of the Instrument and does not purport to be a legal interpretation.) This Order provides for the transfer of certain functions conferred on the Minister to Transport, Tourism, and Sport under the Road Safety Authority (Commercial Vehicle Roadworthiness) Act 2012 (No. 16 of 2012) to the Road Safety Authority relating to the: (
- a)arrangements for the testing of commercial vehicles and the issuance of certificates of roadworthiness; (
- b)authorisation of commercial vehicle roadworthiness test operators and testers; (
- c)suspension and revocation of authorisations and handling of appeals where an authorisation is suspended or revoked; and (
- d)appointment of authorised officers, CVR inspectors and deciding officers.
