I, LEO VARADKAR, Minister for Transport, Tourism and Sport, in exercise of the powers conferred on me by section 79 (as amended by section 16 of the Harbours (Amendment) Act 2009 (No. 26 of 2009)) of the Harbours Act 1996 (No. 11 of 1996) and the Maritime Transport, Safety and Security (Transfer of Departmental Administration and Ministerial Functions) Order 2005 ( S.I. No. 842 of 2005 ) (as adapted by the Transport (Alteration of Name of Department and Title of Minister) Order 2011 ( S.I. No. 141 of 2011 )), hereby order as follows: 1. This order may be cited as the Harbours Act 1996 (Establishment of the Pilotage District of Fenit Harbour) Order 2013. 2. A pilotage district, the limits of which are specified in Article 3 and which shall be known as, and is in this Order referred to as, the “Pilotage District of Fenit Harbour”, is hereby established. 3. The limits of the pilotage district of Fenit Harbour shall be the navigable waters of the bays, creeks, rivers and canals on the landward side of an imaginary line drawn from Kerry Head to the westernmost of the Magharee Islands. 4. There is hereby conferred on Kerry County Council the function of organising and ensuring the provision of pilotage services in the Pilotage District of Fenit Harbour, by one of the means specified in section 56
