exercise of the powers conferred on me by section 39 of the Electricity Regulation Act 1999 (No. 23 of 1999)(as adapted by the Communications, Marine and Natural Resources (Alteration of Name of Department and Title of Minister) Order 2007 ( S.I. No. 706 of 2007 )), following consultation with the Minister for the Environment, Community and Local Government and having,

accordance with section 39

(10)of that Act, given a draft of the following order to the persons upon which the obligations concerned are to be imposed, hereby order as follows:
  1. This Order may be cited as the Electricity Regulation Act 1999 (Public Service Obligations) (Amendment) Order
  2. 2.

this Order, “Order of 2012” means the Electricity Regulation Act 1999 (Public Service Obligations) (Amendment) Order 2012 ( S.I. No. 438 of 2012 ). 3. The Electricity Regulation Act 1999 (Public Service Obligations) Order 2002 ( S.I. No. 217 of 2002 ) is amended— (a)

Article 4

(1G) (as amended by Article 2(

  1. c)of the Order of 2012), by substituting for subparagraph (
  2. d)the following: “(d)

the case of REFIT 2, the public service obligations imposed pursuant to Article 6D shall commence not later than 31 December 2017.”, (b)

Article 6D (as amended by Article 2(d) of the Order of 2012), by substituting for paragraph

(2)the following: “
(2)The obligation imposed pursuant to paragraph
(1)shall not, as respects a supplier referred to

column

(3), require that supplier to have available to it and purchase the electricity concerned— (a) for a period

excess of 15 years, or (b)

the case of— (

  1. i)REFIT 1, after 31 December 2027, (
  2. ii)REFIT 2, after 31 December 2032, and (iii) REFIT 3, after 31 December 2030.”, (c)

Article 7, by substituting for paragraph

(4)(as amended by Article 2(e) of the Order of 2012) the following: “

respect of the obligation imposed by Article 6D the PSO Levy imposed shall terminate— (a)

the case of REFIT 1, no later than 31 December 2029, (b)

the case of REFIT 2, no later than 31 December 2034, and (c)

the case of REFIT 3, no later than 31 December 2032.”, (d) by substituting for Part 3 of Schedule 1 the following: “Renewable, Sustainable or Alternative Energy
