I, JAMES REILLY, Minister for Health, in exercise of the powers conferred on me by section 1
(7)of the Irish Medicines Board (Miscellaneous Provisions) Act 2006 (No. 3 of 2006) (as adapted by the Health and Children (Alteration of Name of Department and Title of Minister) Order 2011 ( S.I. No. 219 of 2011 )), hereby order as follows:
- This Order may be cited as the Irish Medicines Board (Miscellaneous Provisions) Act 2006 (Certain Provisions) (Commencement) Order
- The 1st day of December 2013 is appointed as the day on which the following provisions of the Irish Medicines Board (Miscellaneous Provisions) Act 2006 (No. 3 of 2006) shall come into operation: (a) section 5; (b) section 6; (c) section 8; (d) section 9; and (e) subparagraph (v) of section 11(a), in so far as that subparagraph inserts paragraphs (r), (s), (u) and (v) into subsection
(1)of section 4 of the Irish Medicines Board Act 1995 (No. 29 of 1995). GIVEN under my Official Seal, 27 November
- JAMES REILLY, Minister for Health. EXPLANATORY NOTE (This note is not part of the Instrument and does not purport to be a legal interpretation.) This Order may be cited as the Irish Medicines Board (Miscellaneous Provisions) Act 2006 (Certain Provisions) (Commencement) Order
- The effect of the Order is to commence provisions of the Irish Medicines Board (Miscellaneous Provisions) Act 2006 relevant to
(1)the position of pharmacy companies, their directors, etc., in respect of certain prohibition directions that may be issued by the Minister for Health following a conviction for an offence relating to controlled drugs,
(2)the power of the Minister for Health to inform the Nursing and Midwifery Board if a special direction has issued relating to a registered nurse,
(3)the prohibition on the growing of poppies,
(4)the powers to inspect and demand production of drugs, books or documents,
(5)the authorisation of persons under section 24 of the Misuse of Drugs Act 1977 (as amended by section 9 of the Irish Medicines Board (Miscellaneous Provisions) Act 2006 ),
(6)the exercise by the Irish Medicines Board of the powers conferred on the competent authority by Directive 2001/20/EC of the European Parliament and of the Council of 4 April 2001,
(7)the exercise by the Irish Medicines Board of the powers conferred on the competent authority by Directive 2004/23/EC of the European Parliament and of the Council of 31 March 2004 and
(8)the right of the Irish Medicines Board to perform such other functions as are conferred on the Board by enactment.
