I, PASCHAL DONOHOE, Minister for Transport, Tourism and Sport, in exercise of the powers conferred on me by section 3 of the European Communities Act 1972 (No. 27 of 1972) and for the purpose of giving effect to Commission Implementing Directive 2014/37/EU of 27 February 20141 , hereby make the following regulations: Citation 1.
(1)These Regulations may be cited as the European Communities (Compulsory Use of Safety Belts and Child Restraint Systems in Motor Vehicles) (Amendment) Regulations 2014.
(2)These Regulations and the Principal Regulations may be cited together as the European Communities (Compulsory Use of Safety Belts and Child Restraint Systems in Motor Vehicles) Regulations 2006 and
- Commencement
- These Regulations shall come into operation on 15 September,
- Interpretation
- In these Regulations “Principal Regulations” means the European Communities (Compulsory Use of Safety Belts and Child Restraint Systems in Motor Vehicles) Regulations 2006 ( S.I. No. 240 of 2006 ). Amendment of Regulation 2 of the Principal Regulations
- Regulation 2
(1)of the Principal Regulations is amended— (
- a)by substituting for the definition of “appropriate child restraint system” the following: “ ‘appropriate child restraint system’ means a child restraint system which is suitable for the child’s physical features in accordance with— (
- a)the classification provided for in Article 1
(3)of Directive 91/671/EEC for child restraint systems approved in accordance with Regulation 3(
- a)or (b), and (
- b)the size range and maximum occupant mass for which the child restraint system is intended, as indicated by the manufacturer, for child restraint systems approved in accordance with Regulation 3(c).”, (
- b)by deleting the definition of “approved child restraint system”, and (
- c)by inserting after the definition of “design gross vehicle weight” the following definition: “ ‘Directive 91/671/EEC’ means Council Directive 91/671/EEC of 16 December 19912 , as amended by Directive 2003/20/EC of the European Parliament and of the Council of 8 April 20033 and Commission Implementing Directive 2014/37/EU of 27 February 20141;”. Amendment of Regulation 3 of the Principal Regulations 5. The Principal Regulations are amended by substituting for Regulation 3 the following: “3. A child restraint system the use of which is required by these Regulations shall be approved to the standards of— (
- a)the Standard’s Directive, (
- b)Regulation 44/03 of the United Nations Economic Commission for Europe, or (
- c)Regulation 129 of the United Nations Economic Commission for Europe, or any subsequent adaptation thereto, and shall be installed in accordance with the fitting information (whether set out in an instruction manual, a leaflet, an electronic publication or by any other means) provided by the manufacturer of the child restraint system declaring in what manner and in which vehicle types the system may be safely used.” GIVEN under my Official Seal, 7 August 2014. These Regulations give effect to Commission Implementing Directive 2014/37/EU of 27 February 2014 which provides for enhanced requirements for child restraint systems. These Regulations amend the European Communities (Compulsory Use of Safety Belts and Child Restraint Systems in Motor Vehicles) Regulations 2006.
