I, MICHAEL NOONAN, Minister for Finance, in exercise of the powers conferred on me by section 4 of the Financial Transfers Act 1992 (No. 27 of 1992) and for the purpose of giving full effect to Council Regulation (EU) No 208/2014 of 5 March 20141 as amended by Council Implementing Regulation (EU) No 381/2014 of 14 April 20142 , Council Regulation (EU) No 269/2014 of 17 March 20143 as amended by Council Implementing Regulation (EU) No 961/2014 of 8 September 20144 , Council Regulation (EU) No 692/2014 of 23 June 20145 as amended by Council Regulation (EU) No 825/2014 of 30 July 20146 and Council Regulation (EU) No 833/2014 of 31 July 20147 as amended by Council Regulation (EU) No 960/2014 of 8 September 20148 , hereby order as follows: 1. This Order may be cited as the Financial Transfers (Restrictive Measures Concerning Ukraine) (Prohibition) (No. 2) Order 2014. 2.

(1)In this Order— “Council Regulation (EU) No 208/2014” means Council Regulation (EU) No 208/2014 of 5 March 20141 as amended by Council Implementing Regulation (EU) No 381/2014 of 14 April 20142; “Council Regulation (EU) No 269/2014” means Council Regulation (EU) No 269/2014 of 17 March 20143 as amended by Council Regulation (EU) No 959/2014 of 8 September 20149 and Council Implementing Regulation (EU) No 961/2014 of 8 September of 20144; “Council Regulation (EU) No 692/2014” means Council Regulation (EU) No 692/2014 of 23 June 20145 as amended by Council Regulation (EU) No 825/2014 of 30 July 20146; “Council Regulation (EU) No 833/2014” means Council Regulation (EU) No 833/2014 of 31 July 20147 as amended by Council Regulation (EU) No 960/2014 of 8 September 20148; “Council Regulations” means Council Regulation (EU) No 208/2014, Council Regulation (EU) No 269/2014, Council Regulation (EU) No 692/2014 and Council Regulation (EU) No 833/2014.
(2)A word or expression which is used in this Order and which is also used in the Council Regulations has, unless the context otherwise requires, the same meaning in this Order as it has in the Council Regulations.
  1. A person shall not make a financial transfer between the State and another country the effect of which would be to enable or facilitate, directly or indirectly, the doing of any thing which is a contravention of the Council Regulations.
  2. Notwithstanding Article 3, a person who has been granted or is deemed to have been granted an authorisation under Article 4, 5 or 6 of Council Regulation (EU) No 208/2014, Article 4, 5 or 6 of Council Regulation (EU) No 269/2014 or Article 2, 3 or 4 of Council Regulation (EU) No 833/2014 may, subject to compliance with the terms and conditions of the authorisation concerned, do such of the things as are so authorised.
  3. A person shall not do anything to directly or indirectly assist in the circumvention of this Order.
  4. The Financial Transfers (Restrictive Measures Concerning Ukraine) (Prohibition) Order 2014 (S.I. No. 184/2014) is revoked. GIVEN under my Official Seal, 13 October
