I, ALAN KELLY, Minister for the Environment, Community and Local Government, in exercise of the powers conferred on me by section 50 of the Housing (Miscellaneous Provisions) Act 2014 (No. 21 of 2014), hereby make the following regulations: 1. These Regulations may be cited as the Housing Assistance Payment (Section 50) (No. 3) Regulations 2014. 2.
(1)Part 4 of the Housing (Miscellaneous Provisions) Act 2014 (No. 21 of 2014) shall be applied from 18 December 2014 by each housing authority referred to in paragraph
(2)in respect of qualified households that— (
- a)consist of a person or persons regarded by a housing authority as being homeless, within the meaning of section 2 of the Housing Act 1988 (No. 28 of 1988), and (
- b)on 1 December 2014 or at any time during the 6 months preceding that date, occupied accommodation or lodgings made available to them by virtue of section 10
(1)of the Housing Act 1988 .
(2)The housing authorities for the purposes of paragraph
(1)are— (
- a)Dublin City Council, (
- b)Dun Laoghaire-Rathdown County Council, and (

EXPLANATORY NOTE (This note is not part of the Instrument and does not purport to be a legal interpretation) For the purpose of facilitating the phased introduction of the new Housing Assistance Payment scheme under the Housing (Miscellaneous Provisions) Act 2014 , these Regulations provide that Part 4 of the Act will be applied from 18 December 2014 by Dublin City Council, Dun Laoghaire-Rathdown County Council and Fingal County Council in respect of homeless households qualified for social housing support that stayed in emergency accommodation on 1 December 2014 or at any time within the preceding 6 months.
