I, SIMON COVENEY, Minister for Agriculture, Food and the Marine, in exercise of the powers conferred on me by sections 3 and 15 of the Sea-Fisheries and Maritime Jurisdiction Act 2006 (No. 8 of 2006) and the Sea-Fisheries, Foreshore and Dumping at Sea (Transfer of Departmental Administration and Ministerial Functions) Order 2007 ( S.I. No. 707 of 2007 ) (as adapted by the Agriculture, Fisheries and Food (Alteration of Name of Department and Title of Minister) Order 2011 ( S.I. No. 455 of 2011 )), hereby make the following regulations: 1.

(1)These Regulations may be cited as the Sea-Fisheries and Maritime Jurisdiction (Mussel Seed) (Opening of Fisheries) (Castlemaine) Regulations 2015.
(2)These Regulations shall come into operation on 18 December 2015 and shall cease to have effect on 22 January
  2. In these Regulations- “mussel seed” means mussels (mytilus edulis) whether alive or dead and includes any part of a mussel and the shell, or any part of the shell, of a mussel and which are not intended for direct human consumption; “Dingle Bay” means the geographical area east of an imaginary line drawn from: Latitude 52°06.5487’N, Longitude 009°56.9101’W through Latitude 52°06.5000’N, Longitude 010°00.0167’W through Latitude 52°04.8833’N, Longitude 009°59.9500’W to Latitude 52°04.8833’N, Longitude 009°58.5230’W.
  3. Subject to Fisheries Natura Declaration No. 1 of 2011 (made under Regulation 4 of the European Communities (Natural Habitats and Birds) (Sea-Fisheries) Regulations 2009 ( S.I. No. 346 of 2009 )), a person may fish for mussel seed in Dingle Bay where that person holds an authorisation to fish for mussel seed granted under section 13 of the Sea-Fisheries and Maritime Jurisdiction Act 2006 or a licence granted by the relevant competent authority of Northern Ireland.
